Licensing Program Analyst (LPA), Elizabeth Larios, met with Licensee, Sofia Ramirez, for unannounced pre-licensing inspection for change of location and increase capacity at Family Child Care Home (FCCH). Upon arrival, LPA was admitted into the home by Licensee and toured inside and outside of the family child care home (FCCH).

Applicant states that adults over the age of 18 living in the home are spouse (Alejandro Ramirez) and son (Agustin Junior). Licensee additionally has three minor child living in the home. The hours of operation for the FCCH will be Monday-Friday, 7:00AM-5:30PM and the Licensee is planning to offer care for children ages 3-12. Licensee has submitted proof of residency for the home and does not currently have liability insurance for the day care. LPA advised applicant to provide parents with Affidavit Regarding Liability Insurance (LIC282) upon registration until liability insurance is potentially purchased in the future.

Applicant was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA toured inside the home and observed sufficient materials, toys, and play equipment for day care children. Off limits inside the home include: the second floor (all four bedrooms & bathrooms). There are stairs that are properly barricaded for children. There is a working telephone (cell phone) at the FCCH. Licensee currently has four (8) mats available for napping and plans to purchase more if needed and also has two cribs. Licensee states that she does plan to administer medication or provide incidental medical services to children. Food will be prepared and provided by the FCCH, Licensee states that she plans to serve breakfast, lunch, and AM/PM snack. LPA observed cleaning compounds and kitchen knives properly stored inaccessible to children. Licensee states there are no weapons or firearms in the home.

LPA toured outside the facility and observed the play area for children to be fenced in and equipped with playground that will not be in use until backyard construction is completed. Playground is correctly located in the left side of backyard in the cement area that is off limits. LPA reminded Licensee that resilient material needs to be placed around the playground. Off-limits outside the home include: back yard only cement area will be within limits until construction is complete. Licensee states that she is planning to add additional fence to barricade far end of backyard where dog house is located and cut wood logs that are stored and covered. LPA advised Licensee to submit photos of yard and fence once it has been completed/installed. No outdoor bodies of water were observed during todays inspection.

LPA observed fully charged 3A40BC fire extinguisher near kitchen and a 2A10BC located in the garage, working smoke detector and carbon monoxide detector. LPA advised completing annual maintenance for fire extinguisher. Licensee was provided fire/emergency disaster drill log and was advised it should be completed every 6 months.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual- Regulation Interpretations and Procedures for Family Child Care Homes, Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee states that for discipline of the children, she will talk with the child or redirect to another activity. Licensee states that if the child's behavior is more challenging, she may create a "quiet area" for the child to calm down. LPA advised Licensee that if utilized, recommended duration for "time out" as 1 minute per year of age for the child.

Licensee understands that children's personal rights should not be violated; including no corporal punishment. Children should not be left for extended periods of time in furniture such as a high chair or play pen. LPA discussed isolation of sick children with the Licensee and she states that if a child were to start feeling sick at her home that she would isolate the child using a couch in the living room and provide separate toys for the child until they are picked up.

LPA additionally discussed supervision of children, transporting children, unusual incidents (LIC624B), reporting suspected child abuse, and requirements for additional staff/ adults living in the home. The Licensee states that she does not plan to transport children and understands that she must be home at least 80% of the time FCCH is open.

LPA reviewed small & large family child care home capacity requirements with the Licensee and provided copy of 102416.5 Staffing Ratio and Capacity from California Code of Regulations. LPA advised Licensee that infants are children under 2 years of age (birth to 24 months). The Licensee understands the requirements of one (1) child in kindergarten or elementary school and at least one (1) child age eleven (11) for capacity of eight (14) and that there should never be more than three (three) infants present at the FCCH. LPA advised Licensee that her minor daughters will be included in her capacity/ratio for children in care.

LPA discussed required postings with Licensee and provided copies of Parents Rights bulletin (PUB394) and Earthquake Preparedness Checklist (LIC9148). LPA reviewed and provided documents to Licensee for children's files, personnel files, and facility records (LIC311D). LPA discussed Provider Information Notices (PINs) with applicant and stated was already enrolled. LPA additionally reviewed CCLD website with applicant for Resource & Referral and online annual fee payment.

Licensee states that she is planning to enroll any infants into her FCCH, LPA discussed the safe sleep regulations with Licensee and provided the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.

Exit interview conducted and report was reviewed with the Licensee, Sofia Ramirez.

LPA advised applicant that a large family day care license will be issued pending manager review and completion of the following corrections:
