32 | During the May 29, 2026 site visit, LPA Larios observed multiple ratio violations when staff took bathroom breaks or moved between classrooms. At approximately 10:45 AM, LPA observed 21 children present with one (1) qualified staff (S1) and one (1) unqualified aide (S2), placing the group out of ratio. Additional ratio issues occurred during staff breaks and restroom use. LPA Larios observed a child to child (C1 & C2) incident occur, due to inadequate supervision as a result of the facilities' failure to maintain ratio requirements.
Based on the information gathered and LPA's direct observations, the Department found that the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
As a result of this Complaint Investigation, a Type A Deficiency is cited, more details provided on the attached LIC9099D.
LPA Jennifer Beehler informed Facility Representative, Marissa Cooney-Moore that this report dated 07/30/2026 documents one (1) Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Jennifer Beehler informed the Facility Representative, Marissa Cooney-Moore to provide a copy of this licensing report dated 07/30/2026 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
LPA provided the LIC9224 with today's date.
Exit interview conducted with the Director. Report was reviewed and provided to the Director Marissa Cooney-Moore, along with appeal rights.
A NOTICE OF SITE VISIT WAS GIVEN AND MUST REMAIN POSTED FOR 30 DAYS. |
