32 | On 6/4/24 and 6/5/24 LPA E. Laird interviewed five parents (P1, P2, P3, P4, P5). Two of the parents interviewed stated they had observed unqualified staff alone in the infant room. One parent stated they had observed an unqualified staff in the infant room alone on a weekly basis. One parent stated they had observed the infant room operating out of ratio and stated they had observed one staff watching 5 infants on more than one occasion.
On 4/18/24, 6/5/24, and 6/25/24 LPA E. Laird conducted an interview with seven staff (S1, S2, S3, S4, S5, S6, S7). One staff interviewed admitted to working alone in the infant room without having any Early Childhood Education Units (ECE). Three staff interviewed admitted to observing the infant room operating out of ratio. One staff interviewed stated staffing is always an issue and they had observed the infant room operate out of ratio on several occasions.
On 4/23/24 LPA Laird obtained staff transcripts, the facility roster, and staff roster. Transcripts obtained indicate two staff did not have the necessary infant units and one staff did not have any ECE units.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
LPA Erica Laird informed facility director, Anoma Thilakeratne that this report dated 6/25/24 documents 1 Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Laird informed the facility director to provide a copy of this licensing report dated 6/25/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with facility director, Anoma Thilakeratne. Appeal rights were provided.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
