On 10/1/21 at 10:30 AM, Licensing Program Analyst (LPA) Pheej Cheng and Dawn Keane conducted an unannounced case management visit as directed by the department and met with Interim Administrator Cameron Olson. Prior to initiating the visit, LPA completed required COVID-19 testing protocols, and a daily self-screening questionnaire for symptoms of COVID-19 infection to affirm no COVID-19 related symptoms; contacted Administrator and completed a facility risk assessment. LPA ensured they applied hand sanitizer before entering the facility and the following Personal Protective Equipment (PPE) was worn: surgical mask and gloves. Additionally, LPA was screened by staff Olson.


A case management visit was held on 10/1/21 to follow up on a substantiated allegation of physical/sexual abuse. Licensing Program Analyst (LPA) Pheej Cheng and Dawn Keane met with Interim Administrator, Cameron Olson, at Joaquin House in Redding, California.

On April 8, 2021, the Department concluded a complaint investigation which alleged that the staff physically/sexually abused a resident in care.

The Department substantiated the incident’s investigation, and the licensee was cited for violating California Code of Regulations (CCR) Title 22, § 80072(a)(2) Personal Rights. During the course of the investigation, it was determined that the facility did not protect Resident 1 (R1)’s dignity in personal relationship with staff and that this posed an immediate health and safety risk to clients in care.

On September 4, 2019, the Department conducted interviews and record reviews and was able to determine that a facility staff member (S1) engaged in sexual acts with a resident (R1). The Department interviewed multiple people to include R1 and multiple facility employees. On additional subsequent dates, interviews took place with the Redding Police Department, R1’s psychiatrist, additional facility staff members, and S1. The culmination of interviews with S1 and R1 affirmed that S1 inappropriately touched R1’s clothed and bare breasts and that S1 then propositioned R1 for oral sex. On November 19, 2019, S1 was interviewed jointly with CCLD and a Redding Police Department Investigator. On this date, S1 stated that on August 17, 2019, he was working for the facility, that he was the only staff on shift at the time, and that R1 was “behaving inappropriately,” while the other two residents were in bed asleep. S1 stated he was aware R1 had a mental capacity of a thirteen- to fifteen-year-old, yet he touched R1’s breasts, allowed R1 to touch S1’s penis both under and over clothing, and allowed R1 to put S1’s penis in R1’s mouth. This went on for anywhere between thirty to ninety seconds. During this joint interview, S1 went on to say he “could have stopped” R1 because he “is a big guy,” and that he understands R1 was not able to consent to these interactions. S1 acknowledged he was aware it was inappropriate for facility staff to engage in personal relationships like this with residents of the facility and S1 acknowledged that he allowed it to take place.

At the time of the complaint management visit on April 8, 2021, an immediate civil penalty of $500 was issued and the licensee was informed that an additional civil penalty was still being determined and might be assessed based on Health and Safety Code § 1548.

The Department has concluded an analysis and has determined that a civil penalty is warranted for physical/sexual abuse. California Welfare and Institutions code § 15610.63(e), “sexual assault, that means any of the following:” and lists: (e)(7) oral copulation, as defined in California Penal Code 287. Penal Code 287(d)(1)(C) makes it a criminal offense when the victim is incapable because of a developmental or physical disability of giving legal consent and that this disability is known to the person committing the act.

Today, 10/1/21, the Department will be issuing a civil penalty per Health and Safety Code § 1548 for a violation that the Department constitutes as physical abuse in the amount $10,000. However, since an immediate civil penalty of $500 was issued on April 8, 2021, the amount today will be $9,500.

A copy of the LIC 421D was given to Interim Administrator Cameron Olson and originals were signed.
