On February 11, 2026, Licensing Program Analyst (LPA) Ivan Avila conducted an unannounced complaint investigation visit regarding the above allegations directed by the Department. LPA Avila met with Administrator Christian Herr and explained the purpose of the visit.

During the investigation process, interviews and records review were initiated.

LPA investigated the allegation, “Staff discriminate against resident in care.” Residents reported that staff treat them with dignity and respect. Residents explained they have a good relationship with staff. Residents reported that there have been times when there have been misunderstandings, but residents have not seen staff discriminate against residents.

LPA investigated the allegation, “Staff did not ensure that resident received medical attention as necessary.” Residents reported that their medical needs are being met, and facility staff provide medical assistance as necessary. Residents reported staff schedule medical appointments and follow ups when needed. Staff explained their procedures when scheduling medical appointments for all residents and rescheduled appointments when there is a cancellation.

LPA investigated the allegation, “Staff did not ensure that resident was provided transportation as necessary.” Residents reported that staff provided transportation to appointments and to their place of work. Residents explained that staff pick up residents at the end of the day from their workplace and bring them back home.

LPA investigated the allegation, “Staff did not ensure that resident participated in outings.” Residents reported that they participate in outings weekly. Residents reported they accompany staff when shopping for food and community outings. Residents reported that they have not seen staff deny outings to residents.

LPA investigated the allegation, “Staff financially abused resident(s) in care.” Residents reported that they have not had staff deny them access to their money. Residents reported that they spend their money once they receive it through work or through monthly deposits. Staff explained their procedures when handling residents’ money and allowing them to spend their own money. Staff reported they provide budget meetings to help educate residents on how to manage their spending. Residents reported they have not experienced any form of financial abuse while in care.

LPA investigated the allegation, “Staff discourage residents from reporting incidents while in care.” Residents reported that they have not been instructed by staff to not report incidents. Residents explained that they have called agencies to report facility issues in the past and facility staff have encouraged them to express their concerns. Residents reported that staff have provided the number for community care licensing to report issues.

Based on interviews conducted and record review, the preponderance of evidence standards has not been met. Therefore, the above allegations are found to be UNSUBSTANTIATED. Findings that the complaint is Unsubstantiated means that, although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

An exit interview was conducted, and a copy of the report was provided.
