On 7/16/24 at 8:45am, Licensing Program Analyst (LPA) Nicolette Cunningham conducted an unannounced complaint inspection, and met with facility representative Robin Perez. It was alleged that the facility is operating out of ratio and staff left a daycare child in a soiled diaper.

Facility representative Robin Perez was interviewed on 5/2/24 at 11:31am and denied all of the allegations, and stated that she steps in to help when needed so the facility always operates within ratio and staff change children at specific times throughout the day and before they go home. Four staff and were interviewed on 4/30, 6/25, and 7/1/24 and interviews provided conflicting information regarding how many children staff supervise. Interviews revealed that staff check children’s diaper at scheduled times and before they depart the facility. Seven parents were interviewed on 4/30, 6/25, and 7/1/24 and stated they don’t take a head count when they walk in the classroom but have not observed anything to cause concern. Parents also reported that they have not smelled a bad odor in the classroom to indicate children were left in dirty diapers. One parent reporterd there was one day when their child left with a wet diaper. On 4/30/24 and 7/16/24, LPA did not observe a smell to indicate children were left in a soiled diaper.

LPA obtained a copy of the diaper log for 7/15/24 that shows the time of when each child had their diaper change.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.



Exit interview conducted and report was reviewed with the facility representative. Appeal rights were provided.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

On 7/16/24 at 8:45am, Licensing Program Analyst (LPA) Nicolette Cunningham conducted an unannounced complaint inspection, and met with facility representative Robin Perez. It was alleged that staff yell at children in care.

A facility representative was interviewed on 5/2/24 at 11:31am and denied the allegation, and stated that staff communicate appropriately with children. Four staff and were interviewed on 4/30, 6/25, and 7/1/24 and staff reported hearing other staff sometimes use their teacher voice which is a firm tone. Seven parents were interviewed on 6/25/24 and two parents provided examples of times when they observed staff use a rude or bossy tone while communicating with children.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
