On 12/20/24 at 4:30pm, Licensing Program Analyst (LPA) Emily Curiel and Nicolette Cunningham conducted an unannounced complaint inspection, and met with facility representative, Nicole Bull. It was alleged that the licensee does not ensure staff have mandated reporter training.

The facility representative was interviewed on 10/21/24 at 9:00am and stated there’s been several staff changes. The facility representative provided a copy of the personnel report (LIC500) which indicates eight staff provide care for infants. The facility representative provided mandated reporter training certificates for five staff. The facility representative was unable to provide valid mandated reporter certificates for three staff.

On 12/20/24 at 4:30pm, Licensing Program Analyst (LPA) Emily Curiel and Nicolette Cunningham conducted an unannounced complaint inspection, and met with facility representative, Nicole Bull. It was alleged that Licensee allows unqualified staff to provide care and supervision to infants, specifically, staff have not completed sufficient college units for the position they perform.

The facility representative was interviewed on 10/21/24 at 9:00am and stated there’s been several staff changes. The facility representative provided a copy of the personnel report (LIC500) which indicates eight staff provide care for infants. The facility representative also provided staff transcripts for three employees.

Three staff were interviewed on 12/16/24 and listed a daily schedule of staff that provides care for infants. Interviews revealed that an aide often provides care for four infants between 4-5pm.

During today’s inspection, the facility was toured, and LPAs observed three staff supervising ten children.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

Exit interview conducted and report was reviewed with the facility representative Nicole Bull. Appeal rights were provided.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

During today’s inspection, the facility was toured, LPA observed two teachers and one aide providing care for ten infants. Two of the three staff providing care stated they have not completed mandated reporter training.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.

Exit interview conducted and report was reviewed with facility representative Nicole Bull. Appeal rights were provided.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.
