32 | LPA interviewed staff (S1) on 10/22/24 and stated that they have 3 dogs in the home, and they clean the backyard every other day after the dog poop and they shovel it into the trash. S1 stated that children play outside depending on what the weather conditions are like.
LPA interviewed witness (W1) on 10/21/24 and stated that they have observed children playing outside in the backyard during child care hours with dog feces on the ground. They stated that they observed dog poop everywhere in the backyard and also on the concrete of the play yard.
LPA interviewed parents (P1-P4) on 12/6/24 and 4 of 4 parents stated no they have not witnessed children playing outside in the backyard with dog feces on the play yard. 1 of 4 parents stated they have witnessed S1 cleaning up dog poop before the kids go outside.
On 10/22/24 LPA observed dog feces in the back yard that children use as a play yard, at the time LPA did not observe children playing outside.
During today’s inspection, the facility was toured. LPA observed 9 children playing outside and 2 children inside. LPA observed children playing in the backyard and did not observe any dog feces outside in the play yard.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. |
