On March 22, 2024 at approximately 4:00pm, Licensing Program Analyst (LPA) Nicolette Cunningham conducted an unannounced complaint inspection, and met with licensee Kelsey Porter. It was alleged on 1/11/24 the licensee handled a child (C1) in a rough manner, the licensee yelled at children, the licensee spoke inappropriately in the presence of children, and the licensee did not accord child dignity in their relationship with staff or other persons.

On 1/12/24, the licensee reported an unusual incident to CCL stating there was a difference of opinion between staff and parents on 1/11/24 when she sent two children home sick. The licensee was interviewed on 1/22/24 at 1:20pm and denied all the allegations. The licensee stated she treats all daycare children like her own children. The licensee provided copies of text messages regarding Child 1 and Child 2 on 1/11/24. Two staff members (S1 and S2) were interviewed on 1/22/24 and 3/20/24 and stated they have not observed the licensee handle children in a rough manner, yell at children, speak inappropriately to children or not accord a child dignity. On 1/31/24 at approximately 3:00pm, LPA Cunningham and Friese conducted an interview with Child 1 and Child 2 but were unable to qualify the two children. Child 1 described the licensee as nice. Child 1 also reported their arm was swollen because it hurt but did not state how they hurt their arm.

One child (C4) was interviewed on 3/22/24 and stated her friends at the facility are happy and the licensee is nice. On 1/31 and 2/28/24, LPA interviewed four parents (P2-P5). Three parents (P3-P5) reported they have always observed the licensee act appropriate around daycare children in a loving manner. Parent 2 reported Child 1 stated they hurt their arm but did not observe Child 1 hurt their arm.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

Exit interview conducted and report was reviewed with the licensee Kelsey Porter.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
