13 | On June 29, 2023 at 3:30pm, Licensing Program Analyst (LPA) N. Cunningham conducted an unannounced complaint inspection, and met with licensee Brown. It was alleged that the licensee left day care children to be supervised by minors and the garage is not kept at a comfortable temperature.
The licensee was interviewed on 3/9/2023 at 9:10am and stated that one of her assistants is under 18 years of age but has never been left alone with daycare children. The licensee also stated that the garage is used for outdoor play activities during the Winter. The licensee also stated that children play in the garage for a short amount of time and spend most of the day inside the home. On 3/9/23, LPA observed the licensee supervising five children in the main home.
The licensee’s two assistants (Witness 1 and 2) stated the licensee always ensures a qualified assistant over 18 is present when she leaves the home. The licensee’s two assistants also stated that children play outside in the garage for a short amount of time and spend most of the day in the home. Four witnesses (Witness 3-6) did not corroborate the allegations.
Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.
