On November 17, 2023 at 11:00am, Licensing Program Analyst (LPA) N. Cunningham conducted an unannounced complaint inspection, and met with licensee Brown. It was alleged that the licensee leaves napping infants in a closed room.

The licensee was interviewed on 9/6/23 at 2:30pm and stated infants sleep in the bedroom with a door open or in the living room. On 9/6/23 the licensee was closed so LPA was unable to observe the licensee providing care for infants. On 10/26/23, LPA conducted a subsequent unannounced inspection. The licensee stated LPA’s knock on the door woke up four sleeping infants, so she moved them from the bedroom to the living room. LPA was unable to view the infants sleeping during the inspection.

Four parents (P1-P4) were interviewed on 11/13/23. Parent 2 stated that infants sleep in the bedroom with the door cracked. Parent 3 stated they did not observe infants sleeping at the FCCH. Parent 4 stated they observed infant 1 sleeping in the bedroom with the door closed on approximately four occasions. Safe Sleep Regulations require the provider to be able to visually observe an infant without moving a door.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.

Exit interview conducted and report was reviewed with the licensee. A notice of site visit was given and must remain posted for 30 days. Appeal rights were provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

On November 17, 2023 at 11:00am, Licensing Program Analyst (LPA) N. Cunningham conducted an unannounced complaint inspection, and met with licensee Brown. It was alleged that the licensee does not attend to crying infants.

The licensee was interviewed on 9/6/23 at 2:30pm and stated she always attends to crying infants. On 9/6/23 the licensee was closed so LPA was unable to observe the licensee providing care. On 10/26/23, LPA conducted a subsequent unannounced inspection and observed the licensee appropriately interacting with four infants and one preschool age child.

Four parents (P1-P4) were interviewed on 11/13/23. Parent 1 reported Child 2 will reach for the licensee in the morning. Parent 1 also reported they have observed the licensee comforting Child 2 when they arrive at the end of the day. Parent 2 reported they have not observed the licensee interacting with infants but noted that Child 3 enjoyed going to the FCCH. Parent 3 reported they have not observed the licensee interacting with infants and described the licensee as hands off. Parent 4 stated when they enter the home, they always find the licensee playing with the infants.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. Exit interview conducted and report was reviewed with the licensee. A notice of site visit was given and must remain posted for 30 days. Appeal rights were provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
