On 2/3/26 at 4:00pm, Licensing Program Analyst (LPA) Nicolette Cunningham conducted an unannounced complaint inspection and met with facility representative Maryann Ackley. It was alleged staff behavior poses a risk to the daycare children and staff mishandled a daycare child while in care, specifically, Staff 1 spoke in a loud voice around little children and grabbed Child 1 by the wrist and pulling them around.

The director was interviewed on 11/24/25 at 2:20pm and denied the allegation and stated that she is in Staff 1’s classroom several times a day and has never observed Staff 1 act inappropriately.

On 1/9/25 and 2/3/25, LPA observed children playing in the toddler room and preschool room. During both inspections, LPA checked the children’s wrists and did not observe any bruising or scratches.

Witness 1 was interviewed on 1/7/26, and did not provide any information that corroborated the allegations.

Child 1’s parent reported that they have not observed any bruising on Child 1’s body and that Child 1 has not exhibited behavior indicating fear of Staff 1.

Staff 1 stated that they have a loud voice but denied speaking inappropriately in front of children. Staff 1 also denied handling any child in care in an inappropriate manner.

During today’s inspection, LPA observed three staff providing care for eight children.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

Exit interview conducted and report was reviewed with the facility representative Maryann Ackley. Appeal rights were provided.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
