13 | On 10/2/24 at 1:45pm, Licensing Program Analyst (LPA) Nicolette Cunningham conducted an unannounced complaint inspection, and met with Hovie Carle. It has been alleged that the licensee operated out of ratio; specifically, on multiple dates the licensee cared for four infants and ten plus children. Regulation 102416.5(d)2(b) states a licensee can care for three infants (child under the age of 2) when more than 12 children are being cared for.
The licensee was interviewed on 7/25/24 at 3:00pm and denied the allegation. Later that day at 6:28pm, the licensee e-mailed LPA Cunningham and stated she reviewed attendance records and realized she provided care for four infants while also providing care for 12 plus children on multiple dates.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
