A annual inspection was made to the facility by Licensing Program Analyst (LPA), Elpidia Hernandez Torres. A review of staff records on 03/29/23 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. There is currently one adults living in the home.

During today’s inspection the home and grounds were toured. The licensee was supervising eight children, one child is enrolled and attending T-K, all children are under six years old, type B deficiency was cited. No children were observed left in any parked vehicle. The facility’s operating hours are 06:30AM to 05:30PM, Monday–Friday. The floor plan submitted by the licensee was reviewed and verified. The off-limits areas of the home are the bed room on the main floor, the garage, the 2nd level and all its rooms. They were made inaccessible by child safety gates, and door locking mechanisms. The home was clean and orderly, and was at a comfortable indoor temperature. There were safe toys and equipment available for children. There is a working telephone in the home. The licensee has current pediatric CPR and First Aid certification, which expire on 09/2024. Items which could pose a danger to children (detergents, cleaning compounds, medications, etc.) were stored out of the reach of children. The regulations that poisons are locked with a key or combination lock was reviewed. The staircase is barricaded with a child safety gate. The fireplace has been made inaccessible with a television and TV stand. There is a working smoke detector, carbon monoxide detector and fire extinguisher, rated at least 2A10BC, in the home. The licensee stated there are no firearms and/or other dangerous weapons in the home, and none were observed during today's inspection. The children use the back yard as the outdoor play area and it is fully fenced. There were no pools or other bodies of water observed in the yard. Five children's records were reviewed at 10:27AM; required emergency information was observed to be on file. All children's records were missing LIC 282, type B deficiency was cited. Infant in care did not have Sleep Log on file type B deficiency was cited.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee Kelly Bowling.

Based on record review Licensee reported she does not carry liability insurance for the daycare and she is not required to. LPA agreed with licensee and reminded licensee although it's not required to obtain liability insurance, you are required to have LIC 282 signed and on file for each child's record. The licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care.

Based on record review and interview, Eight children were present, all were under 6 years old, one child was enrolled and attending T-K. Licensee reported she usually has an assistant present, how-ever assistant was on vacation currently and she believed she could have eight children present if they were under five years old. LPA printed out regulation and reviewed it with licensee. LPA also gave licensee a ratio hand out illustrating the regulation. the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care.
