A subsequent complaint investigation visit was conducted today by Licensing Program Analyst (LPA), Sebastian Phouthavong who met with Center Director, Branda Hardaway (CD) for the purpose of delivering complaint investigation finding for the above allegation. LPA, previously conducted an inspection on 02/25/2026 to initiate the investigation and met with Center Director to discuss the allegation, conduct interview(s), make observations, and request documents. An additional inspection was conducted on 03/04/2026. It is alleged that there is Neglect/Lack of Supervision at the facility, specifically that there was incident involving Child 1 (c1) and Child 2 (C2) while unsupervised.

During the course of the investigation, LPA conducted interviews with Center Director (CD), six staff (S1 – S6), seven children (C1- C3, C5 – C8), three parents (P1 – P3) and attempted to interview six additional parents (P4 – P9) from 02/25/2026 to 05/05/2026. CD stated to being unable to confirm whether the alleged incident occurred. Additionally, CD stated that staff are required to supervise children at all times, particularly when they are playing under the facility’s play structure, and to intervene to stop any inappropriate behaviors.

Interviews from Staff (S1 – S3) stated to have never observed C2 engaging in inappropriate behaviors at the facility and indicated there have been no prior concerns regarding C2’s behavior. S2 also stated that when the alleged incident was brought to the facility’s attention, C2 was reminded to use kind words when speaking to others. In addition, Staff (S1 – S6) stated that at least two staff members are present to supervise the daycare children in each classroom, including during outdoor time when children are playing in the facility’s play yard. If a child needed assistants indoors when playing outside in the facility’s play yard, Staff (S1, S4 & S5) stated that they would request an additional staff for assistance, while Staff (S2 & S3) stated that some daycare children would accompany them to ensure ratio requirements are being met.

According to children’s interviews, C1 and C2 did not disclose any information, and no corroborating evidence was revealed. Additional interviews with children (C5 – C8) revealed no current concerns regarding the facility at this time. Interviews conducted with Parents (P1 – P3) did not have any concerns regarding the allegation at this time.

Additionally, documentation received from the department did not reveal any supporting information and the facility addressed the alleged incident. The department was unable to determine if the alleged incident occurred at the facility.

Based on the information gathered during this investigation, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the allegation occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the Center Director, Branda Hardaway (CD). Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
