A subsequent complaint investigation visit was conducted today by Licensing Program Analyst (LPA), Sebastian Phouthavong who met with Director, Branda Hardaway for the purpose of delivering complaint investigation findings for the above allegation. LPA previously met with Director on 06/28/2023 to initiate the investigation by discussing the allegation, conducting interview(s), making observations, and requesting documents. It is alleged that Staff do not ensure proper supervision is provided to children in care.

During the course of the investigation, LPA conducted interviews with the Director (D1), nine staff members (S1-S9), five parents (P1-P5), and children from 06/28/2023 – 07/24/2023. Statements from D1 and staff (S1-S9) stated the center has enough staff working and do not have any concerns on supervision at this time. D1, S3 & S4 further stated staff would provide coverage to each other if needed. Interviews from S1, S2 and S8 did indicate there were times previously when they were supervising daycare children alone. In addition, on 6/28/23, LPA observed facility was not in compliance with staff ratios.

D1, S3 & S7 stated if a child was misbehaving, staff would support the child and give them tools to resolve the issue, encourage them to use their words. D1, S3 & S5 further stated an Incident report would be written and a plan would be created with parents if the behavior continued. Interviews from S2, S5 & S7 indicated that there have been Incidents of children misbehaving, but nothing troubling at this time.

According to other interviews, P2 stated that they can understand an incident involving a child misbehaving can be seen as a lack of supervision, but they have not seen or heard anything troubling to them. P3 stated children misbehave all the time and do not believe it is due to staff not providing proper care. P5 stated they were informed by others of having concerns with how Staff provides proper supervision, but they have not seen anything troubling themselves. Interviews from P1-P3, P4 indicated there are no concerns with the facility at this time. Children interviews did not result in any information to corroborate the allegation.

Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility’s Director, Branda Hardaway. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
