Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent complaint investigation visit with center director for the purpose of delivering complaint investigation findings. It has been alleged staff handled day care child in rough manner.

During the initial investigation interviews were conducted with 11 adults including staff, and guardians between 01/26/23 and 03/20/23. Interviews revealed on at least two occasions a staff member scooped and/or pushed a child away from another child to prevent an injury from occurring. On one occasion one child was running towards another child and the staff member scooped up the child that was standing still to prevent them from being bitten. A similar incident occurred where children were sitting next to each other, and one child was going to bite the other so staff member pushed one child away from the other. Another incident occurred where a child was entering a tunnel in the classroom in the opposite direction then other children, staff member removed the child from the tunnel by pulling her from the legs gently, to let the other children pass through the tunnel. Staff members corroborated the incidents could appear rough from an outsider viewing in, however the children that were prevented from injuries occurring were not harmed and didn’t appear scared or frightened. One guardian reported when someone picks up a toddler that is throwing a fit it can look like they are being rough, but they have never witnessed staff being rough with a child. Two guardians corroborated they have never seen staff being rough with their children.

Based on interviews conducted and records reviewed Staff are not being rough with children to discipline or purposely handle them in a rough manner. The incidents observed were to prevent further injury from happening. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated. This report was reviewed and discussed with Center Director, She was provided with a copy of this CIR; and Appeal Rights. All licensing reports are public information and must be made available upon request for at least three years.

Licensing Program Analyst (LPA), Elpidia Hernandez Torres, conducted a subsequent complaint investigation inspection on 04/04/2023 for the purpose of delivering the findings regarding the above allegation. LPA previously met with center director Wendy Certeza to discuss the purpose of the visit and request personnel records , Staff schedules, contact numbers, and sign in/ out log. It was alleged that staff yelled at child in care.
During the course of the investigation, interviews were conducted with 11 adults including staff, and guardians between 01/26/23 and 03/20/23. According to interviews there was an incident that occurred where staff had told a child to stop playing a certain way and the child stopped, then another staff member went over to the child and told them in their face to stop. Two additional interviews corroborated the staff’s actions reporting, the same staff member has yelled at children phrases such as “get down and what are you doing”.

The interviews revealed the yelling isn’t towards one particular child. Guardian interview revealed they have seen staff yell in the direction of their child “ you need to calm down now”, but their child kept yelling. An interview revealed the music is loud during quiet time and there is more yelling than they would like to hear. Another staff interview revealed management have talked to the staff member and the staff member is good for a few weeks but then they go back to their old ways. One staff member reported the staff in the classroom don’t use a harsh tone but do use a stern voice. Center director and assistant center director corroborated they have talked to the staff and are working with them on how to better react towards the children.

Through the course of investigation interviews corroborated staff member has yelled at day care child/ children. Therefore, the preponderance of evidence standard has been met and the above allegation is found to be substantiated. The California Code of Regulations, Title 22, Division 12 & Chapter 1, section……. 102423(a)(3) is being cited on attached LIC 9099D . This report was reviewed with the Center Director and an exit interview was conducted. A copy was provided and Notice of Site Visit shall be posted for 30 days. Appeal Rights were provided.

Center director reported assistant center director is taking more time working directly with the staff members of the classroom. Her training includes how to talk to the children, the approach to the children. More shasowing is being conducted to prevent this from happening again. We are making ourselves more visual in the classroom. We are begining to talk to them one on one and more support.
