13 | Licensing Program Analyst (LPA) Dianne Allee made an unannounced complaint investigation visit today and met with Licensee Nina Simmons (LS) for the purpose of delivering findings for the above allegations. LPAs Dianne Allee and Leticia Rosales-Meza previously met with Licensee Nina Simmons on 03/20/2026 to open the complaint.
During the course of the investigation, LPAs Allee and Rosales-Meza conducted interviews and received documents pertaining to the investigation. From 03/20/2026 through 06/09/2026, interviews were conducted with Licensee (LS), staff (S1), three parents (P1, P2 & P4) and an additional adult interview was attempted.
Licensee (LS) denied the allegations, stating she has a “no hands policy”. LS further stated she will sit down with the child and guide them through what happened and how to deal with the situation better the next time. LS stated if she continues to have a problem with a child, she will take the activity away until they earn it back. In addition, LS stated she is stern and speaks louder than most people.
Parent interviews (P2 & P4) stated they have never observed or heard of LS yelling at children or handling them inappropriately, further stating they are satisfied with the care provided. P4 further stated that children will receive a time out if they are misbehaving but felt it was more of a place for the children to take time to think about what they did. While interview with parent (P1) stated their child told them LS has yelled at children in care when they do not listen and has grabbed their child’s shirt while forcing them to sit in a chair.
Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred and therefore is determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with Licensee, Nina Simmons. Appeal rights were provided.
Notice of Site Visit shall be posted for 30 days from today's visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
