On 10/24/25, Licensing Program Analyst (LPA) Cindy Castro, made a subsequent complaint investigation inspection, for the purpose of delivering complaint findings and met with Licensee, Wilhelmina Junio (LS). It has been alleged that licensee uses highchair to restrain day care child.

An inspection was conducted on 08/13/25 to initiate and make observations. During the investigation interviews were conducted with reporting party, licensee, staff, children and parents. Interviews were conducted between 08/12/25 –10/23/25.

Licensee denied allegations stating that children are given breaks, a book or redirected with another activity as a form of discipline. LS admitted there was one exception in which a parent had requested that child C1 be put in a highchair. LS reported there were two occasions in which C1 was placed on a highchair due to a tantrum or as a form of redirecting behaviors with a puzzle but not for punishment. LS also reported putting C1 in a highchair per parental request, while waiting for C1’s parent to arrive for pick up. LS added that she only only put C1 in highchair on one occassion to keep the other children safe and C1 safe because C1 was throwing items and hitting.

Staff (S1) corroborate that there was one occasion on which C1 was placed on a highchair by LS due to C1 hitting and throwing objects. S1 added that putting C1 in the highchair was for the safety of the other children.

Based on interviews conducted which revealed children’s personal rights violations, CCR Code 102423. Licensee was advised that highchairs may only be used for their intended purpose in accordance with the guidance set forth by manufacturers and may not be used in a manner that violates children’s personal rights. LS was reminded that discipline should be free from corporal or unusual punishment. LPA Castro provided licensee with a copy of Personal Rights Regulations, and a plan of correction was discussed with Licensee.

Based on information obtained from interviews and the licensee’s own admission, the preponderance of evidence standard has been met; therefore, the above allegations are found to be substantiated. California Code of Regulations, Title 22, was cited on the LIC 809-D issued during today’s inspection. Appeal rights were provided. An exit interview was conducted, and this report was read and discussed with the licensee, Wilhelmina Junio. The Notice of Site Visit shall be posted for 30 days.

102423 Personal Rights (a)Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (4)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning.
