Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent complaint investigation visit with licensee Pamela Melders for the purpose of delivering complaint investigation findings. It has been alleged licensee interferes with child's napping period.

During the initial investigation interviews were conducted licensee, assistant, and six guardians ( G1-G6), between 02/05/2024- 04/05/2024. On 02/06/2024 Licensee reported nap time is from 12:30PM-02:30PM, new children who are not on the routine yet are told its ‘night night time’ and have their backs rubbed. Licensee further reported none of the children are forced to sleep. Assistant reported if children arrive early In the morning the children are allowed to lay down until breakfast time. One guardian (G1) reported their older child doesn’t always take a nap but is quiet during nap time to allow others to rest. Another guardian (G3) reported the licensee had given them the day care nap schedule before beginning care, so G3 adjusted their child’s nap schedule at home to match the day care nap schedule so it would be an easier transition when they began. G3 also reported if their child was tired or needed an extra nap the licensee would allow the child to sleep.

Licensee reported there was one occasion where she conducted a family interview during nap time, there was one day care child present and napping, and another child was awake playing and running around the napping child, that could have appeared as if the licensee was interfering with the napping child’s rest. Licensee’s assistant corroborated the statement. On 02/28/2024, licensee reported there was another occasion where a child was having a tough day and licensee reached out to guardian via text message to inquire how to help the child. Guardian reported to licensee it was the child’s nap time, and licensee replied back she would attempt to feed the child then lay the child down for nap. Licensee reported she only has one nap/rest period scheduled for the day care.

Another guardian (G2) reported their child wouldn’t sleep during nap time, and licensee would communicate with G2 that the child was awake and speaking to other children during nap time. Guardian (G5) corroborated the statement reporting, licensee communicated with them a few times their child kept everybody awake so no one took a nap. G5 also reported licensee woke up child from nap because nap time was over, but couldn’t recall the exact dates that occurred.

LPA reviewed Licensee’s enrollment packet for children currently enrolled and reviewed licensee’s nap/rest policy which states “25. Nap/Rest Time: Each child is required to have a rest period. If your child(ren) no longer naps he/she may look at a book, or watch a movie but must remain quiet for the other children…”

Based on interviews conducted and records reviewed, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated. This report was reviewed and discussed with licensee, She was provided with a copy of this CIR; and Appeal Rights. All licensing reports are public information and must be made available upon request for at least three years.



There were no Title 22 deficiencies cited during today’s inspection.
