Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent complaint investigation visit with center director for the purpose of delivering complaint investigation findings. It has been alleged Staff inappropriately handled child in care.

During the initial investigation an interview was conducted with center director, two staff (S1,S2) and three children (C1-C3) on 05/09/2023. Center Director reported she coaches staff on the appropriate way to handle children and some staff may have blocked a child with their hands to prevent an injury from occurring. S1 reported they have seen a teacher place themselves in between two children to prevent the children from hitting each other. S1 also reported they have placed their hands out to prevent a child from running away while S1 was talking to the child.

S2 reported they have not seen any staff handle any child inappropriately, and the only time a staff has placed their hands on a child has been when children run up to staff to give them a hug. Children interviews revealed, there was one occasion when a child was getting dropped off at school and a teacher helped a child off of the vehicle by holding them, then walked them to school. C3 reported staff only put their hands on children when children get hurt and the staff give hugs.

Interviews were conducted with, one staff member (S3) five guardians ( G1-G5) and one child ( C4) between 05/08/2023 and 07/31/2023. Interviews revealed if children are not listening or following direction another staff member will intervene by sitting next to the child and speak to them to try and calm them down. Some guardians expressed they have no concerns about any staff members inappropriately handling children in care. Guardian interviews reveled, the center will discipline children by placing them on time out and will talk to the child about what they did that was wrong. Some guardians reported the staff have never handled their children in an in-appropriate manner. One interview revealed, their child was running in the classroom and they walked in to see a staff member bear hugging the child. C2 reported there was an incident during naptime where a child didn’t want to lay down and was running around so a staff member was holding the child to calm them down and the child was crying and screaming. Another Child corroborated the statement reporting a staff member grabbed them by wrapping their arms around them.

Based on interviews conducted, the preponderance of evidence standard has been met and the above allegation is found to be substantiated. The California Code of Regulations, Title 22, Division 12 & Chapter 1, section 101223(a)(3) is being cited on attached LIC 9099D . This report was reviewed with the Center Director and an exit interview was conducted. Signature was recorded on this Complaint Investigation Report (CIR), and a copy was provided. Notice of Site Visit shall be posted for 30 days. Appeal Rights were provided.

Center Director agreed to conduct an all staff training, reviewing the appropirete way to help a child calm down. Center director will submit the items reviewed and the sign in sheet of all the staff who attended the meeting.

Based on interviews conducted Staff S1, wrapped their arms around a child in an attempt to calm them down. This poses a potential health and safety risk to children in care.
