32 | Oldani stated that the facility has strict guidelines regarding how staff may interact with children. Oldani stated that staff are prohibited from yelling at children or making inappropriate or demeaning comments to or about children. Oldani stated that she has never observed or heard any staff members yelling at children or making inappropriate statements towards children. Oldani stated that staff may raise their voices to get the children’s attention, however. Oldani stated that children at the facility are never isolated from their classmates as a form of punishment or humiliation.
Oldani stated that the facility never uses any form of corporal or unusual punishment, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature. Oldani stated that the facility does not use timeouts. Instead, the facility uses redirection, positive reinforcement, and provides alternate activities to children having behavioral issues. Oldani stated that in situations where a child is hurting another child or escalating in behavior, the center director may be called to assist and speak with the child privately outside of the classroom. Oldani stated that the child is always allowed to rejoin their classmates once they have calmed down.
During the investigation, staff members S2-S6 were interviewed on 04/08/22 beginning at 11:23am and S7 on 05/23/22 at 01:22pm. The staff members that were interviewed corroborated the center director’s statements. The staff members that were interviewed stated that they have not observed any instance(s) where a staff member violated a child’s personal rights by isolating a child, making inappropriate comments towards a child, or yelling at a child. During the LPA’s inspection visits to the facility on 04/08/22, 04/18/22, and 06/13/22, the LPA did not observe any inappropriate forms of discipline or other personal rights issues. During both inspection visits, staff were observed interacting and engaging with all children. The LPA did not observe any children being yelled at or hear any inappropriate comments made by staff members.
Interviews were also conducted with the childcare facility’s clients and children. The clients that were interviewed all stated that they did not have any health and safety concerns regarding the center and have not observed any instance where a child’s personal rights were violated by a staff member. Clients that were interviewed stated that they have not heard any staff member(s) yelling or making inappropriate statements to children or other staff members. The children that were interviewed during the complaint investigation all stated that they felt safe while attending the center and did not have any concerns about any staff member. The children that were interviewed all stated that they did not recall any instance where a staff member yelled at them or a classmate.
