32 | During the initial investigation visit on 11/02/20/22, the center director provided documentation requested for former and working staff and children and incident report that occurred on 09/16/22 for child C1 in which an allegation of a child being pinched by teacher S3 was investigated by the school and Department.
During the investigation, LPA conducted interviews of parents and staff including but not limited to the ones that are still at facility. According with interviews conducted children are supervised and teachers ensure that ratios are maintained when in need of removing themselves from the group. Parents enrolled at facility have not observed any child unsupervised. There was a teepee being used at facility when a child needed some time away from the group which was being used by former Director Sabrina Oldani. Director Sabrina stated that she would keep children supervised at all times when using the teepee.
In addition, per teachers’ interviews children that are going through a stressful day and/or demonstrating a need to deescalate are removed from the group so teachers can talk and listen to them and given time to relax before coming back to the group. There were 5 parents that were interviewed and none of the parents have seen or heard from their children that a teacher had them disciplined inappropriate.
Although it was alleged that child C1 could have been pinched by a teacher, child C1 did not sustain any injuries, however; C1 was very upset and didn’t want to go back to the school. Based on available information and interviews conducted, there was not a preponderance of evidence to prove that staff left day care child unsupervised; staff used inappropriate discipline with child in care; and staff pinched a child or any other violation of regulations. Therefore, the allegations are unsubstantiated. All licensing reports are public information and must be made available upon request for at least three years. This report was read and reviewed with the center director, Yvette Pimentel. There were no Title 22 deficiencies cited during today's inspection. Appeal rights were provided. The Notice of Site Visit shall be posted for at least 30 days. |
