On 09/11/24, Licensing Program Analyst (LPA) Cindy Castro, made a subsequent complaint investigation inspection, for the purpose of delivering complaint findings, and met with Center Director, Noemi Gomez. It has been alleged that Licensee is operating the facility out of ratio, that Licensee does not ensure the facility is maintained sanitary, that Licensee does not ensure staff are qualified to provide care to children, that Licensee does not ensure that the facility is maintained in good repair and Licensee does not ensure that the children are observed for illness prior to acceptance into facility.
LPA, previously conducted an inspection on 07/18/2024 to initiate the investigation and met with Center Director to discuss the allegations, conduct interviews, make observations, and request documents.
During the investigation, LPA conducted interviews with the Center Director (CD), six staff (S1-S6), five parents (P1-P5) from 07/18/2024 to 09/09/2024. Center Director denied allegations and stated that facility is fully staffed with 13 staff total, including herself and that each preschool classroom has two teachers. CD added that facility has fully qualified teachers and aides are enrolled in Early Childhood Education Units. Continued on LIC9099-C

CD stated the facility is currently cleaned by staff due to Janitorial company services ending in May 2024 because they were not doing a good job. Opening staff clean up what is left from the prior day, check trash and check toilets. Closers wipe the toilets and during naptime or end of day when numbers are low, the counters and shelves are wiped. CD reported that when something is not working in the building it gets fixed right away. CD reported that in the mornings she is upfront conducting well checks. If a child becomes sick during the day, she supervises the sick child up front while waiting for parent to pick up. CD further added that parents are reminded of the illness policy and that their child needs to be 24 hours symptom free before returning to the center.

LPA observed facility on 07/18/2024 and during today’s visit 09/11/2024, operating in ratio.

In addition, staff and parent statements did not present any concerns and did not corroborate the allegations.

Based on the information gathered during this investigation, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with Center Director, Noemi Gomez. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
