32 | Staff corroborated the statement adding there have been days where 8 children have been present, and there are 8 children enrolled. Staff also reported there are times where C8 is present, and C8’s father has removed C8 from the day-care. All guardian interviews revealed they have never been present in the day care while there have been 8 children present. One guardian reported they may have seen 8 children present in a picture they received through the bright wheel app, but they couldn’t remember the date. Another guardian reported sometimes the class appears to be a little fuller but has not counted the number of children present.
LPA reviewed the sign in/out files from 01/15/2024- 02/16/2024, and identified more than two dates where 8 children were present at the same. LPA also reviewed pictures which had 8 infants present at the same time. The facility was licensed on 07/09/2021 with a max capacity of 7 infants. The facility is in violation of the approved fire clearance granted by Fairfield Fire department upon which the clearance is based. Therefore, the preponderance of evidence standard has been met and the above allegation is found to be substantiated. The California Code of Regulations, Title 22, Division 12 & Chapter 1, section 101171(a) is being cited on attached LIC 9099D. An immediate civil penalty in the amount of $500 is being issued. LPA Hernandez Torres informed center director to provide a copy of this licensing report dated 05/02/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with center director. LPA Hernandez Torres informed center director that this report dated 05/02/2024 document(s) one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Appeal rights were provided.
