25 | An unannounced Case Management visit was made by Licensing Program Analyst (LPA), M. Augustin, in response to an Unusual Incident Repot (UIR) which involved allegations of a child (C1) being inappropriately touched. The report noted there was allegedly blood in C1's underwear. The facility self-reported the incident and submitted a UIR to the Department on 05/09/23. LPA met with the Center Director, Miesha Bell (CD) to initiate the investigation by discussing the purpose of the visit, conducting interviews with CD and staff (S1 & S2), and requested facility roster of the children currently in care.
During the visit, LPA observed four children in care and upon LPA's arrival, the children were napping. CD denied claims about C1 being inappropriately touched, hit or harmed at the facility by another child or staff, and to CD's knowledge, staff never left the children unattended, and when the children used the bathroom, the children used the bathroom one at a time. Interviews provided by S1 & S2 did not report any concerns of lack of or absence of supervision. Staff stated they never left children unattended, and all children are supervised during indoor & outdoor play and bathroom break, C1 was not involved in any altercation with another child or staff; and staff confirmed the bathroom policy as described by CD. Furthermore, S1 claimed she did not see blood in C1's underwear, but instead saw dried feces.
LPA did not observe any hazards indoor or on the playground, and during the children's nap time, staff were actively supervising the children in the class. LPA consulted on California Code of Regulation(s), 101229, and CD appeared to have acknowledged and understood she was required to provide constant visual supervision, and no child(ren) shall be left without the supervision of a teacher at any time. There was no indication of lack of or absence of supervision, or evidence to support claims about C1 being inappropriately touch. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with CD. There were no violation(s) of California Code of Regulations, Title 22, Division 12, cited at this time. |
