Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent complaint investigation visit with regional supervisor for the purpose of delivering complaint investigation findings. It has been alleged, Staff do not ensure adequate care and supervision is being provided to children. Specifically that a child opened an emergency door setting off an alarm and led two other children outside.

During the investigation interviews were conducted with 9 adults ( A1-A9) and two children between 07/24/24- 10/18/24. Regional supervisor reported this was the first time she heard of this incident, and was not aware when it happened or who was present when it allegedly happened, there has been new staff and if it happened it was not reported to her. Some staff reported there is supervision at all times in the classrooms, especially when there are two staff members in the classroom.

Other interviews revealed if there is one staff member in the classroom and they need additional support they will call for help using the phone in the classroom, but there were a few times staff popped their head out of the classroom and asked for support by talking to the front desk from the door of the classroom. Other interviews revealed, staff had seen children stand around the door but never open the emergency exit. Another interview revealed there was a child who did know how to open the emergency door and was teaching other children how to open the door. There was one occasion where the child open the door and the alarm did sound, but staff do not remember seeing any children walk outside the classroom. When children got close to the emergency door, staff would call the children’s name over and the children would step back from the door. This only happened a few times and usually while the staff was attending to other children. Some guardians’ interviews revealed they have not had any issues with staff supervision of children. One guardian reported they were told their child had exited the classroom when another guardian arrived to pick up their child and opened the class door, but a staff brought the child back into the classroom, it only happened once and the child did not exit the center only the classroom. Another guardian reported they were notified by the center that children were attempting to open the door.

Based on interviews conducted and records reviewed, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated.

This report was reviewed and discussed with Regional supervisor, She was provided with a copy of this CIR; and Appeal Rights. All licensing reports are public information and must be made available upon request for at least three years.

There were no Title 22 deficiencies cited during today’s inspection.
