Licensing Program Analyst (LPA) Jessica Gaumann made an unannounced complaint investigation visit today and met with the Director (D1), Janice Crane for the purpose of delivering findings. It is alleged staff instructed daycare children to mistreat another daycare child and staff are not providing adequate care and supervision, specifically during the transition from lunch to nap time. LPA previously met with D1 on 06/16/26 to open the complaint.

During the course of the investigation, LPA conducted interviews, made observations and received documents pertaining to the investigation. From 06/10/26 to 07/16/26 interviews were conducted with D1, Licensee (L1), staff (S1-S3), parents (P1-P7), adult (A1) and children (C1-C5).

L1 and D1 denied the allegations. L1 stated the only concern she has regarding supervision is when the facility is short staffed but she will send someone from her other facility to help for the day. D1 stated that during the lunch to nap transition, one staff will take a group of children to the restroom, while two other staff members are assisting children at the tables and cleaning. In addition, D1 stated when the children are done in the restroom they sit on the carpet while the nap room is being set up so there is constant supervision of the children. S1 stated three staff are with the children during the lunch to nap transition corroborating D1’s statement, while S2 stated the nap transition is hard as the children are running around during that time. Interviews with L1, D1 and staff (S1-S3) did not reveal that staff instruct children to mistreat other children at the facility.

Parent interviews (P1-P7) revealed no concerns that staff instruct children to mistreat other children or concerns that staff do not provide adequate care and supervision to their children at the facility.

Interviews with children (C1-C5) did not reveal that they had been instructed by staff to mistreat other children.

Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the Director, Janice Crane. Appeal rights were provided. Notice of site visit shall be posted for 30 days from today's visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Interviews with S1 and S2 revealed they witnessed a former staff member slap child (C6). S1 and S2 stated the children were lined up outside before transitioning back inside. C6 was at the door and opened the door a few times. The former staff member told C6 not to open the door and slapped C6’s hands.

Interview with D1 revealed that occasionally children receive a special snack. D1 gave an example as ice cream. D1 stated that if children do not want to go sleep during nap time, she tells them they will not get the special snack if they do not go to sleep. D1 stated that most of the time the child will then go to sleep so they do get the special snack, but if they do not, they are given a different snack than the other children.

Based on the information gathered during this investigation, the preponderance of the evidence standard has been met. Therefore, the allegations are determined to be substantiated. California Code of Regulations, Title 22, is being cited on the attached LIC 9099-D. Appeal rights were provided. An exit interview was conducted, and this report was read and discussed with the Director, Jance Crane. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Director (D1) stated she will conduct a staff training where staff will view the Children's Personal Rights in Child Care video from CCLD website. D1 will submit sign in sheet from staff meeting for proof of staff who attended to the Department by 08/06/26 via email to: jessica.gaumann@dss.ca.gov

Based on interviews conducted, a former staff member slapped C6 and D1 stated they threaten children by offering them a different snack if they do not go to sleep, which poses an immediate health, safety and personal rights risk to the children in care.
