An unannounced follow-up complaint investigation visit was conducted by Licensing Program Analyst (LPA) Yang to deliver the findings of the complaint investigation. The allegations stated that staff restrained children in care; the Licensee allowed a minor to work as child care center personnel; the facility was not maintained in a clean and sanitary condition; staff served spoiled food to children in care, resulting in illness; staff force-fed infants in care; staff did not prevent children from harming other children in care; staff did not maintain required teacher-to-infant ratios; staff forced children to nap; staff engaged in punitive actions by isolating a child from dining with other children; staff exposed children to extreme weather conditions; and staff did not possess the required Early Childhood Education (ECE) units.

Specifically, it was alleged that infants were placed in highchairs, including outdoors, to de-escalate their behavior; the Licensee permitted her school age family member to work at the facility on multiple occasions; staff do not clean children's tables and toys; children were served spoiled or moldy fruit that resulted in illness; staff force-fed infants and required children to nap early for staff convenience; staff did not intervene when a child (C1) bit other children; one staff member was left alone supervising eight infants; a child (C2) was not permitted to eat at the same table as the other children; children were taken outdoors during excessively hot summer or cold winter weather; and staff working at the facility did not possess the required Early Childhood Education (ECE) units to work in the role they were assigned.

During the initial complaint investigation on May 28, 2026, LPA Yang interviewed Center Director/Licensee Martha Barron Botello (Staff S1) regarding the allegations. The Licensee denied all allegations and provided additional information regarding the concerns. This facility is a single license, combination center with an infant and preschool age component.

The Licensee denied that staff use highchairs as a form of restraint or place infants in highchairs to control or de-escalate their behavior. The Licensee stated that highchairs are used only during feeding times or for other appropriate, supervised care activities and are never used as a disciplinary measure or to restrict an infant's movement. The Licensee stated that infants are not required to remain in highchairs longer than necessary to complete meals or snacks and are removed from the highchair once they have finished eating.

The Licensee further denied that infants are placed outdoors in highchairs to calm down or manage their behavior. The Licensee explained that if an infant becomes upset or begins crying, staff are expected to respond promptly by assessing the infant's needs and providing appropriate care. According to the Licensee, staff comfort infants by holding, rocking, talking to, or otherwise soothing them, and by addressing the child's individual needs, such as feeding, diapering, or providing opportunities for rest or age-appropriate play.

The Licensee stated that staff receive instruction on providing responsive, individualized care to infants and are expected to recognize and respond appropriately to infants' verbal and nonverbal cues. The Licensee further stated that equipment, including highchairs, is not used as a means of behavior management, discipline, or restraint. According to the Licensee, staff are expected to maintain active supervision of infants at all times while they are seated in highchairs and to ensure that the use of equipment is limited to its intended purpose.

The Licensee denied permitting a minor to work as childcare center personnel. The Licensee stated that her school-age niece has visited the facility on a few occasions but has never been employed by the facility, assigned staff responsibilities, counted in the required teacher-to-child ratios, or left alone to supervise children. The Licensee explained that when her niece is present at the facility, she remains under the Licensee's direct care and supervision and typically accompanies the Licensee throughout the day. The Licensee stated that her niece does not provide care to children, assist with classroom duties, or perform tasks that are the responsibility of childcare staff.

The Licensee further stated that only qualified and authorized staff members provide care and supervision to children in care. According to the Licensee, all employees are hired in accordance with applicable licensing requirements and are assigned duties consistent with their qualifications and responsibilities.

The Licensee denied that the facility was maintained in an unsanitary condition or that staff failed to clean children's tables and toys. The Licensee stated that staff follow established cleaning and sanitation procedures throughout the day to help maintain a clean and healthy environment for children in care. The Licensee stated that a combination of wipes and disinfectant sprays are used. The Licensee explained that tables are cleaned and sanitized before and after meals, snacks, and classroom activities, as needed. The Licensee further stated that toys, classroom equipment, and frequently touched surfaces are cleaned, sanitized, and disinfected on a regular basis and more frequently when items become visibly soiled or have been mouthed by infants or toddlers.
According to the Licensee, staff are responsible for maintaining the cleanliness of their assigned classrooms and completing routine cleaning tasks throughout the day in addition to scheduled cleaning performed at the end of each day. The Licensee stated that staff receive instruction regarding the facility's cleaning and sanitation procedures and are expected to follow those procedures to ensure the classrooms remain clean, sanitary, and safe for children in care. The licensee stated that on Friday, the main classroom teachers typically perform a deep cleaning which includes sanitizing all surfaces. The Licensee stated that over the weekend, the facility hires a house keeper to disinfect floors, walls, blinds, and the facility’s bathrooms.

The Licensee further stated that the facility is a "shoes off" facility and that staff members and children remove their outdoor shoes before entering the classrooms. According to the Licensee, this practice is implemented to help maintain classroom cleanliness and reduce the introduction of dirt, debris, and potential contaminants into areas where children are cared for.

The Licensee denied that spoiled or moldy food had ever been served to children in care. The Licensee stated that all food is visually inspected before being served and that any food appearing spoiled, moldy, expired, or otherwise unsuitable for consumption is immediately discarded. The Licensee further denied any knowledge that a child's illness, rash, or other medical condition was caused by food served at the facility.

The Licensee explained that breakfast and lunch are prepared off-site by a local restaurant and delivered to the facility daily. According to the Licensee, staff inspect the meals upon delivery and again prior to serving them to children. The Licensee stated that afternoon snacks are prepared on-site and typically consist of items such as freshly cut fruit and other age-appropriate snacks. The Licensee stated that staff are expected to follow safe food handling and sanitation practices when storing, preparing, and serving food. The Licensee further stated that she has never observed staff serve spoiled or moldy food to children. According to the Licensee, if any fruit or other food item appears overripe, moldy, damaged, or otherwise questionable, it is immediately discarded and is not served to children or saved for future use. The Licensee denied that staff force-feed infants or require children to nap for staff convenience. The Licensee stated that infants are fed in accordance with their individual feeding plans, developmental needs, and parents' instructions. The Licensee explained that staff encourage children to eat during scheduled meals and feedings but do not force children to eat or consume food against their will. The Licensee stated that staff are expected to recognize and respond to each infant's individual hunger and satiety cues and that alternative feeding methods or additional encouragement may be used when appropriate. However, the Licensee denied that staff physically force-feed children or use coercive feeding practices.

The Licensee further stated that daily rest periods are scheduled in accordance with the facility's program and applicable licensing requirements. According to the Licensee, children are encouraged to rest during designated nap times but are not physically forced to sleep. The Licensee explained that staff create a quiet and calm environment during rest periods and provide alternative quiet activities, when appropriate and consistent with each child's age and developmental needs, for children who are unable to fall asleep.

The Licensee further stated that infants are not placed on a fixed sleeping schedule. Instead, staff monitor each infant's individual sleep cues and allow infants to nap according to their own needs and routines. The Licensee acknowledged that it is common for multiple infants to sleep at the same time; however, she stated that this occurs naturally based on the infants' individual sleep patterns and daily routines and not because staff require infants to sleep at specific times. The Licensee stated that rest periods are intended to support children's health, comfort, and developmental needs and are not implemented for the convenience of staff. The Licensee further stated that when infants fall asleep, staff promptly place them in their assigned cribs and continue to monitor them while they rest.

The Licensee stated that the facility schedules designated rest periods for preschool-aged children as part of the daily program but denied that children are required to sleep. The Licensee explained that children who do not fall asleep are permitted to remain quietly on their cots or participate in an alternative quiet activity, such as looking at a book. The Licensee stated that if a child becomes disruptive during rest time, staff provide an alternate age-appropriate activity to allow the child to remain engaged while maintaining a calm environment for other children.

The Licensee stated that many preschool children naturally fall asleep during rest periods, typically within 10 to 15 minutes after being placed on their cots. The Licensee reiterated that children are never physically forced to nap or sleep and that rest periods are implemented to provide children with an opportunity to rest based on their individual needs. The Licensee denied that staff failed to intervene when children engaged in aggressive behavior or that staff allowed children to harm other children without intervention. The Licensee stated that staff actively supervise children throughout the day and are expected to intervene immediately when unsafe or aggressive behaviors are observed, including biting, hitting, pushing, or other behaviors that may result in injury.

The Licensee acknowledged that biting may occur among young children, particularly toddlers, due to their developmental stage and limited ability to communicate emotions or needs. However, the Licensee stated that when biting incidents occur, staff promptly separate the children involved, provide comfort and first aid as needed, redirect the child's behavior, and increase supervision to help prevent future incidents. The Licensee further stated that staff communicate with families regarding ongoing behavioral concerns and implement appropriate supervision and behavior guidance strategies when a child demonstrates repeated biting or other challenging behaviors. The Licensee stated that, when necessary, she schedules in-person meetings with children's authorized representatives to discuss concerns and develop strategies to address behavioral needs.

The Licensee specifically denied that child C1 was permitted to bite multiple children without staff intervention. According to the Licensee, staff consistently supervised C1 and reported that C1 was the child who was bitten by another child and was not identified as a child who engaged in biting behavior. The Licensee stated that C1 had been bitten twice since enrollment at the facility. The Licensee further stated that the facility communicates with families through the Brightwheel application and that families involved in biting incidents are notified and provided with incident reports as required.

The Licensee denied that staff did not maintain the required teacher-to-infant ratios. The Licensee stated that staffing schedules are developed and monitored to ensure compliance with applicable licensing requirements and that staff assignments are adjusted throughout the day based on enrollment, attendance, and the needs of the children in care. The Licensee stated that at least two teachers are always assigned to work in the infant classroom.

The Licensee stated that infant classrooms are staffed with the required number of qualified personnel and that staff are not left alone supervising a number of infants that exceeds the allowable ratio. The Licensee explained that additional staff are assigned when needed to maintain appropriate supervision and ratio compliance, including during staff breaks, transitions, and other times when classroom coverage may change. The Licensee specifically denied that any staff member has been left alone supervising eight infants. The Licensee stated that staff are expected to maintain required supervision and ratio requirements at all times and that classroom staffing is monitored to ensure children's safety and well-being. The Licensee further stated that she provides classroom support when needed, including assisting staff with classroom coverage and providing breaks. The Licensee explained that her office is located in an area where she is able to hear activity occurring in the classrooms and stated that she will enter the classrooms to provide assistance when she determines additional support is needed.

The Licensee denied that child C2 or any other child was separated from peers during mealtimes as a form of punishment. The Licensee stated that children may occasionally be seated separately based on developmental needs, classroom management, safety considerations, or individual needs, but not as a disciplinary measure. The Licensee explained that children may be redirected to a different area of the classroom and provided an opportunity to calm down before rejoining the group, when appropriate. The Licensee stated that children are not denied participation in meals or classroom activities and denied that C2 was prevented from eating with other children or intentionally excluded from mealtime activities. The Licensee stated that any temporary separation from peers is conducted with staff supervision and is based on safety concerns, developmental needs, or providing appropriate behavioral support.

The Licensee denied that staff exposed children to unsafe weather conditions. The Licensee stated that outdoor activities are adjusted based on current weather conditions, including temperature and air quality, to ensure children are not exposed to conditions that could pose a health or safety risk. The Licensee stated that staff monitor weather conditions before and during outdoor activities and make adjustments as needed. The Licensee explained that children are provided access to shade and drinking water while playing outdoors, particularly during warmer weather. The Licensee further stated that staff encourage children to take breaks from outdoor activities as needed and monitor children for signs of discomfort.

The Licensee stated that on days when temperatures are excessively hot (above 90 degrees Fahrenheit), cold (below 50 degrees Fahrenheit), or otherwise uncomfortable, outdoor activities may be modified or children remain indoors. The Licensee stated that staff use their judgment and follow safety precautions to ensure outdoor play is appropriate for the weather conditions and the needs of the children in care.

The Licensee denied that staff lacked the required qualifications or did not possess the required Early Childhood Education (ECE) units for their assigned positions. The Licensee stated that all teaching staff meet the educational requirements applicable to their assigned roles and that personnel files containing documentation of staff qualifications are maintained at the facility and available for review. The Licensee explained that staff members who are qualified as teacher aides only are assigned duties consistent with their qualifications and are always paired with a qualified teacher when supervising awake children. The Licensee stated that teacher aides are not assigned responsibilities beyond their authorized role and that classroom assignments are made to ensure compliance with applicable licensing requirements. The Licensee further stated that the facility monitors staff qualifications and maintains documentation to verify that employees meet the educational and training requirements required for their positions.

During the investigation, the LPA interviewed staff members S2 through S10 regarding the allegations on May 28, June 2, June 10, and July 7, 2026. Staff members denied observing or participating in the use of highchairs or other equipment as a form of restraint or behavior management. Staff denied that children were force-fed, required to nap for staff convenience, or separated from peers as a form of punishment. Staff stated that children are provided appropriate care, supervision, meals, rest periods, and behavior guidance based on their individual needs. Staff denied observing spoiled or moldy food being served to children and stated that classroom areas, toys, and equipment are routinely cleaned and sanitized. Staff further denied that children were exposed to unsafe weather conditions, that teacher-to-infant ratios were exceeded, or that unqualified individuals were assigned childcare responsibilities. Staff statements were consistent with and corroborated the information provided by the Licensee. Additionally, children and childcare clients interviewed during the investigation did not provide information to corroborate the allegations.

During each follow-up investigation visit, the LPA conducted a tour of the facility and observed classroom activities, staff-child interactions, and conditions related to the allegations. During the visits, the LPA did not observe any conditions, practices, or interactions that corroborated the allegations. The LPA did not observe spoiled, expired, or visibly contaminated food items during the investigation visits, and no information was obtained to corroborate that children became ill due to food served by the facility. The facility’s classrooms, kitchen, food preparation areas, and storage areas appeared to be maintained in a clean and sanitary condition and were free of litter, rubbish, and visible signs of vermin. The LPA observed staff providing care and supervision to children in accordance with their individual needs, including feeding, diapering, and assisting children with daily routines. No children were observed to be left unattended, and staff were observed maintaining supervision of children in care.

The LPA observed infants and preschool-aged children participating in age-appropriate activities and did not observe the use of highchairs or other equipment as a form of restraint or behavior management. The LPA did not observe any children being force-fed, required to sleep, isolated from peers as a form of discipline, or denied access to routine care activities. Staff were observed interacting with children in an appropriate manner, and the LPA did not observe or hear staff yelling at children or engaging in inappropriate verbal interactions. The LPA did not observe any instances where staff-to-child ratios appeared to exceed allowable limits. Infant classrooms were observed with adequate staffing to provide supervision and care to children present. The LPA reviewed staff qualifications and personnel records during the investigation and did not observe evidence that staff assigned to positions requiring educational qualifications lacked the required documentation.

During the follow-up visits, the LPA did not observe outdoor activities occurring under conditions that appeared unsafe or inconsistent with children’s health and safety needs. No information was obtained during the investigation to corroborate that children were exposed to extreme temperatures or unsafe weather conditions, inadequate supervision, or classroom conditions that posed a health or safety risk. Based on observations conducted during the follow-up visits, the LPA did not observe evidence to support the allegations.

Based on the information obtained through interviews, observations, and records reviewed, there was insufficient evidence to establish that the alleged violations occurred. Although the allegations may have occurred or may be valid, there was not a preponderance of evidence to prove that the alleged violations occurred. Therefore, the allegations are determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the Center Director/Licensee, Martha Barron Botello. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
