32 | Interviews provided by staff, adults, and parent corroborated C1 was left without staff supervision in classroom bathroom for less than 10 minutes. On 03/08/22, the facility submitted an Unusual Incident Report (UIR) which reported C1 went to the bathroom and was left without staff supervision inside Preschool 2 classroom for less than five minutes while the classroom had already transitioned to the outdoor playground.
Based on the investigation, there’s a preponderance of evidence to show there was absence of supervision which resulted in C1 being left without staff supervision in the classroom, and therefore the allegation is substantiated. The facility did not comply with Health and Safety Code (H &SC), 1596.99(c)(3) and an immediate Civil Penalty of $500 is being assessed for absence of supervision. The following Health and Safety Code, Title 22, Division 6, Chapter 3.5 violation is being cited on the following LIC 9099D. Exit interview conducted, and report was reviewed with the Center Director, Jennifer Hansen. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
LPA Melchisedeck Augustin informed Center Director, Jennifer Hansen that this report dated 05/20/2022 document(s) one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA, Melchisedeck Augustin informed the Center Director to provide a copy of this licensing report dated 05/20/2022 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. |
