Licensing Program Analyst Leibert arrived unannounced for the purpose of delivering findings on this complaint. During the course of this investigation statements were taken, documents were obtained and reviewed and site visits were made to the facility. The following determinations are made: Shower logs for the available period for R1 indicate that R1 was given showers in compliance with R1's care plan; Care notes indicate R1 periodically refused staff efforts to provide care, including showers; Complainant claims to have documentation from R1's dentist that would support the allegation that staff do not assist with oral hygiene; Complainant has not produced any documentation regarding R1's oral hygiene; This Department has made many requests for the documentation. Although the allegations may be true, based upon the statements and documents, there is not a preponderance of evidence to prove or, disprove, the allegations. Therefore, the allegations are UNSUBSTANTIATED.

Licensing Program Analyst Leibert arrived unannounced for the purpose of delivering findings on this complaint. During the course of this investigation statements were taken, documents were obtained and reviewed and site visits were made to the facility. The following determinations are made: On or about April 22, 2024, C1 observed R1 to be "unstable and hot" and requested staff to take R1's temperature; R1 had a reported temperature of 102 degrees and was sent for medical treatment; R1 was returned with a diagnosis of urinary tract infection; The Resident Care Notes for April 22, 2024, support the Complainant's statements regarding the incident and indicate that C1, rather than staff, noted R1's change in condition. Based upon the statements made and documents reviewed, there is a preponderance of evidence standard has been met. Therefore, the allegation is SUBSTANTIATED. The following deficiencies were observed (see LIC 9099D) and cited from the California Code of Regulations, Title 22, Division 6 of California Regulation. Failure to correct the deficiency and/or repeat deficiencies within a 12 month period may result in civil penalties. Exit interview conducted and appeal of rights provided.

Administration will provide refresher training to staff on the requirements of 87455 and provide an agenda to CCL by POC date, with follow-up confirmation of training, in order to clear the deficiency.

requirement was not met as evidenced by; On 4/22/2024, Staff did not note that R1 was feverish and required medical attention for UTI. This posed an immediate risk to the health of R1.
