25 | Licensing Program Analyst (LPA), Amy Strother conducted a Plan of Correction (POC) visit and met with facility representative, Board President, Barbara McGee (L1) for the purpose of following up on a Type B deficiency that was cited on 03/09/23. The facility was observed to have water leaking from the ceiling in room 1/2 and water stains in room 5/6 and 7/8. Interviews conducted with the center director on 03/09/23 indicated that the water leaks have been ongoing since January 2023. The agreed upon plan of correction included submitting proof to hire licensed contractors to repair roof, possible HVAC leak and have all water damages remediated by a water damage contractor, with contracts in place by 03/23/23 and completion of repairs completed by the time specified in the contract. On 03/23/23 L1 requested an extension of the POC due date, stating that appointments with the HVAC and roofing company were scheduled for 03/28/23. On 03/27/23, an extension of correction due date was approved to 04/06/23 and a letter confirming the extension emailed to L1. The Department had not received documentation from the facility to clear the POC on or prior to 04/06/23.
During today’s visit, L1 stated that she has met with a HVAC company and a roofing company and is still waiting for initial reports and has not yet entered into contract with any company for repairs, therefore the plan of correction has not been met.
In accordance with California Code of Regulations (CCR), 101195(f), the Department is assessing a Civil Penalty of $100 per day for period of 04/07/2023 through 04/11/2023 because the Licensee did not correct the deficiency by the date specified in the deficiency/penalty review (extension of POC notice). During the inspection L1 stated that children are no longer in care as of 04/06/22. A request for inactive status beginning 04/12/23 is on file. The facility will be placed on inactive status beginning 04/12/23. The facility will be required to prove that the deficiencies have been corrected and have a facility inspection completed prior to reactivating the license.
Exit interview conducted and report reviewed with L1. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights were provided.
