A follow-up complaint investigation visit was made today by Licensing Program Analyst (LPA), Y. Yang to deliver complaint investigation findings. Previously, an investigation visit was made to the facility by the LPA on 11/27/23. It has been alleged that the provider did not prevent inappropriate interactions between children in care and that the provider did not adequately supervise day care children while playing inside of a playhouse. Specifically, it was alleged that due to a lack of supervision, several children in care inappropriately touched one another while inside of a playhouse located in the facility’s backyard.

The LPA met with the facility’s licensee, Diane Rose today to discuss the investigation findings. During the LPA’s initial 11/27/23 site visit, the licensee was interviewed and denied the allegation that staff are not providing sufficient supervision to children in care. The licensee stated that although it is possible that this incident occurred, neither she nor any of her staff members have observed any inappropriate touching between children in care or any unusual behavior from any of the children involved. The licensee stated that once she learned of this alleged incident from a concerned party, she moved the playhouse from the side of the backyard to the center of the backyard where it is more visible. In addition, the licensee reported this alleged incident to Community Care Licensing both verbally and through a written Unusual Incident Report. (Continued on LIC 9099-C)

The licensee stated that children are always supervised while at the facility. The licensee stated that she always has at least one assistant helping her at her facility even if fewer than eight children are present. The licensee stated that the facility’s on-limits areas include the childcare room and the adjacent hall bathroom. All other areas of the home are off limits and inaccessible to children in care. The licensee stated that the facility’s backyard is fully fenced and on-limits to children. The licensee stated that children are not permitted to play in the backyard without the supervision of a staff member. The licensee stated that her and her assistants provide active supervision to the children while they are playing in the backyard by moving around the yard, visually scanning the yard, and interacting with the children on the yard.

During today’s unannounced follow up visit, the LPA observed nine children in care being supervised by the licensee and two staff members. During the LPA’s initial investigation visit, the LPA observed six children being supervised by the licensee and two staff members. The LPA did not observe any evidence of a lack of supervision during any of the site visits. The LPA interviewed the licensee’s two staff members (S2 and S3) on 11/27/23. Both staff members corroborated the licensee’s statements. The LPA also interviewed childcare clients during the complaint investigation. Clients that were interviewed did not provide any corroborating information.

Based on available information, although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility’s Licensee, Diane Rose. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
