32 | The Director stated that, as a result, staff members who lacked the required ECE and/or infant-specific qualifications were assigned to independently supervise children and fulfill classroom teacher responsibilities to ensure classroom coverage during scheduled operating hours. The Director acknowledged that these staff members were performing duties that required qualifications they did not possess under California Code of Regulations, Title 22. The Director stated that several of these staff members were also in the process of taking their ECE classes to become qualified.
As part of the investigation, LPA interviewed staff members S2 through S9 and reviewed personnel records, including documentation of educational qualifications on May 13 and May 27, 2026. Information obtained through staff interviews was consistent with the allegation. Multiple staff members stated that they either did not possess the required Early Childhood Education units or lacked the infant-specific units necessary to qualify as infant teachers. Several staff members further reported that, on more than one occasion, they were assigned to independently supervise awake infants or toddlers in the classroom without the direct supervision of a fully qualified infant teacher, despite not meeting the required educational qualifications. Staff also stated they were responsible for carrying out the same duties and responsibilities expected of qualified teachers while assigned to the classroom.
LPA reviewed the personnel files of the staff members identified during the investigation. The records confirmed that multiple staff members did not possess the educational qualifications required under Title 22 for the positions they were performing. The personnel file review corroborated the statements obtained during interviews and verified that staff who lacked the required qualifications were assigned to independently supervise children and perform responsibilities reserved for qualified teachers.
Based on the Center Director's admission, corroborating staff interviews, and documentation reviewed during the investigation, the preponderance of evidence standard has been met. Therefore, the allegation is substantiated. Therefore, the allegation is substantiated. A violation of the California Code of Regulations, Title 22, is being cited on the attached LIC 9099-D. An exit interview was conducted and the report was reviewed with Center Director Nicole Del Calvo. Appeal rights were provided. The Notice of Site Visit shall be posted for 30 consecutive days. |
