An unannounced follow-up complaint investigation visit to the facility was made today by Licensing Program Analyst (LPA), Y. Yang to deliver complaint investigation findings. The LPA met with Center Director Enivey Orozco and facility Administrator Cindy LaNier. It has been alleged that daycare child C1 sustained an injury while in care due to a lack of supervision and that the facility’s grounds pose a risk to children in care. Specifically, it was alleged that on a specified date, due to a lack of staff supervision and insufficient ground cushioning, C1 fractured their arm after falling from a play structure on the playground.

During the initial investigation visit on 12/21/22, the LPA interviewed the Center Director Enivey Orozco regarding the allegations. The Center Director denied the allegations but acknowledged that C1 did in fact sustain an arm injury while in care that required medical attention. The Center Director stated that she was not present on the playground at the time of the injury but was available on site and assisted after the injury. The Center Director stated that staff members S2, S3, and S4 were present on the playground at the time and tended to C1 after the injuy.(Continued on LIC9099-C)

The Center Director stated that she does not believe the center’s playground poses a risk to children in care. The Center Director stated that wood chip cushioning is present on the playground to absorb impacts and rubber cushioning mats are used on top of the wood chips at the foot of slides. The Center Director stated that staff at the center are trained to actively supervise children and to move around the classroom or playground and visually scan the yard for any potentially hazardous situations.

During the investigation, interviews were conducted with the center’s staff S2-S6 on 12/21/22 and 02/22/23. The staff members that were interviewed corroborated the Center Director’s statements regarding care and supervision. Staff members did not share any concerns regarding the center’s playground or play equipment. Staff S2-S5 were interviewed on 12/21/22 regarding the incident. Staff S2 and S3 both stated that although they did not observe C1 falling, they were positioned in different areas on the playground and actively supervising children and responded after seeing C1 on the ground crying. S4 stated that she was on the opposite of the playground supervising a group of children and did not hear or see C1. S5 stated that she was inside the classroom setting up for nap time and did not observe the incident but heard about it though the classroom’s Walkie Talkie radio. S2 and S3 stated that although they did not observe any injuries or bruising on C1 at the time, C1 was provided an ice pack after gesturing towards their arm. S2 and S3 stated that C1’s authorized representative was notified and C1 was transported to a medical professional for treatment.

Childcare clients who were interviewed during the investigation stated that they have not observed any lack of supervision at the center and did not have any concerns regarding the center’s physical plant or the center’s outdoor play area. Children that were interviewed during the investigation provided the LPA with information regarding the level of supervision provided at the center.

The LPA made a total of three unannounced visits (12/21/22, 02/22/23 and 03/02/23) to the facility to make observations and/or conduct interviews. During the LPA’s initial site visit, the LPA observed that there was wood chip cushioning spread around the playground and underneath climbing structures. The LPA inspected the play structure that C1 was reported to have fallen from. The play structure is an adjustable, Little Tikes brand outdoor climber/jungle gym that includes two slides (the top of the tallest slide is 32” from the ground below). The platform height from ground to the top of the platform is 23''. Per the manufacturer’s warning label stamped on the play structure, the structure is intended for use by up to six children at a time from ages two-to-eight years; the play structure is age appropriate for this preschool program and has no evidence of damage or defects. Per Title 22 regulations “As a condition of licensure, the areas around and under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls.” The LPA observed on 12/21/22 that there was wood chip cushioning around, underneath, and inside the play structures on the playground. The LPA advised the Center Director to monitor the wood chips in high traffic areas for compression and to occasionally rake the existing wood chips to decompress them. During the follow-up visit on 02/22/23, the LPA observed that several inches of additional wood chip cushioning was added on top of existing wood chips in the playground. Staff members were observed to be actively supervising children either on the playground or in the classroom during all visits made by the LPA.

Although it was corroborated that child C1 sustained an injury while in care, there is not a preponderance of evidence to suggest that the injury was caused by a lack of supervision or any other violation of regulations. Based on available information and interviews conducted, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegations are unsubstantiated. All licensing reports are public information and must be made available upon request for at least three years. This report was read and reviewed with Center Director Enivey Orozco and Administrator Cindy LaNier. There were no Title 22 deficiencies cited during today's inspection. Appeal rights were provided.
