32 | The Center Director stated that she does not believe the center’s playground poses a risk to children in care. The Center Director stated that wood chip cushioning is present on the playground to absorb impacts and rubber cushioning mats are used on top of the wood chips at the foot of slides. The Center Director stated that staff at the center are trained to actively supervise children and to move around the classroom or playground and visually scan the yard for any potentially hazardous situations.
During the investigation, interviews were conducted with the center’s staff S2-S6 on 12/21/22 and 02/22/23. The staff members that were interviewed corroborated the Center Director’s statements regarding care and supervision. Staff members did not share any concerns regarding the center’s playground or play equipment. Staff S2-S5 were interviewed on 12/21/22 regarding the incident. Staff S2 and S3 both stated that although they did not observe C1 falling, they were positioned in different areas on the playground and actively supervising children and responded after seeing C1 on the ground crying. S4 stated that she was on the opposite of the playground supervising a group of children and did not hear or see C1. S5 stated that she was inside the classroom setting up for nap time and did not observe the incident but heard about it though the classroom’s Walkie Talkie radio. S2 and S3 stated that although they did not observe any injuries or bruising on C1 at the time, C1 was provided an ice pack after gesturing towards their arm. S2 and S3 stated that C1’s authorized representative was notified and C1 was transported to a medical professional for treatment.
Childcare clients who were interviewed during the investigation stated that they have not observed any lack of supervision at the center and did not have any concerns regarding the center’s physical plant or the center’s outdoor play area. Children that were interviewed during the investigation provided the LPA with information regarding the level of supervision provided at the center.
The LPA made a total of three unannounced visits (12/21/22, 02/22/23 and 03/02/23) to the facility to make observations and/or conduct interviews. During the LPA’s initial site visit, the LPA observed that there was wood chip cushioning spread around the playground and underneath climbing structures. The LPA inspected the play structure that C1 was reported to have fallen from. The play structure is an adjustable, Little Tikes brand outdoor climber/jungle gym that includes two slides (the top of the tallest slide is 32” from the ground below). The platform height from ground to the top of the platform is 23''. Per the manufacturer’s warning label stamped on the play structure, the structure is intended for use by up to six children at a time from ages two-to-eight years; the play structure is age appropriate for this preschool program and has no evidence of damage or defects.
