An annual required inspection was made to the facility by Licensing Program Analyst (LPA), Amy Strother. LPA met with Licensee, Sabrina Meyer (L1). A review of staff records indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

During the inspection the home was toured inside and outside. The licensee was supervising 7 children, Child 1 - Child 7 (C1-C7). Five children in care, C1- C2 and C5-C7 were infants under 2 years old, two children, C3 and C4, are preschool age. The licensee was operating beyond the licensed capacity and ratio requirements, and over ratio by two infants. During the inspection, Licensee called parents of C5 and C7 and they were picked up, bringing the ratio into compliance. The facility’s operating hours are Monday - Friday 7:30am –6:30pm. The floor plan submitted by the licensee was reviewed and verified. The off-limit areas of the home are two bedrooms and the basement, made inaccessible by means of locking latches and/or locked door knobs. The home was clean and orderly, and was at a comfortable indoor temperature. There were safe toys and equipment available for children. There is a working telephone in the home. LPA verified a current mandated reporter training certificate, which expires 06/22/2023. Items which could pose a danger to children (such as detergents, cleaning compounds, medications, etc.) were observed to be stored out of the reach of children. L1 stated that no poisons are located on the premises and none were observed during today's inspection. The fireplace has been made inaccessible with a wooden cabinet. LPA observed a working smoke detector, carbon monoxide detector and fire extinguisher, rated at least 2A10BC, in the home. The roster of children in care was reviewed and was current.

The licensee has conducted an emergency drill within the past six months, last drill was documented on 08/14/22. Licensee stated that no firearms or ammunition are in the home and none were observed during today's inspection. The Licensee has cots available for nap time and a cribs available for the infants in care that are not able to climb out of them. LPA reviewed the safe sleep log used for children under age two. The children use the backyard as the outdoor play area and it is fully fenced. There were no pools or other bodies of water observed. Five children's records were reviewed at and contained documentation as required. Facility and personnel files were reviewed and contained required records.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with the licensee, Sabrina Meyer.

The following violation of the California Code of Regulations, Title 22; Division 12, was observed: see LIC 809D. Appeal Rights were provided.

LPA Strother informed licensee Sabrina Meyer that this report dated 09/29/22 documents one Type A citation. Type A citations which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Based on interview and record review, the licensee did not comply with the section cited above in 2 out of 7 children in care. Licensee had 7 children in care, 4 infants and 3 preschool age children. The licensee was operating beyond the licensed capacity and ratio requirements, and over ratio by two infants, which poses an immediate health, safety or personal rights risk to persons in care.

During the inspection, Licensee called parents of C5 and C7 and they were picked up, bringing the ratio into complaince. L1 stated that she will look at her weekly schedule and work with parents to limit the number of infants to 3 when 6 children and in care and 2 when L1 has 7 or 8 children in care (2 that are school-age). L1 stated that she clearly understands the maximum number of children for whom care can be provided and the limitations on the number of infants (birth to age 2) that may be cared for and when two of the children in care must be school aged and signed a copy of the capacity requirements for small family child care homes. L1 stated that she plans to apply for a large family child care home license in the near future.
