A complaint investigation inspection was conducted at the facility by Licensing Program Analyst (LPA), Amy Strother. It has been alleged that Licensee did not provide adequate supervision to the daycare children, specifically that two infants C1 and C2 were found running in the street of Ridgeway Avenue unsupervised on 11/05/25, and then returned by employees of neighboring Ridgeway High School. It has also been alleged that Licensee does not ensure day care children are provided a safe and comfortable environment while in care, specifically that the detached converted garage was used for care, including napping and was not at a comfortable temperature and that Licensee had prior knowledge that the converted garage was not converted with a permit. LPA met with Licensee, Sabrina Meyer (L1).

The Licensee self reported an Unusual Incident to Community Care Licensing Division (CCLD) the day the incident occurred, 11/05/25; reporting that two children C1 and C2, got through a gate in the backyard, without L1 and assistant S1’s knowledge.

The report states that C2 was returned through the gate and C1 was brought to the front door by two unknown adults. The report stated that the police and a code enforcement officer arrived to her home 20-30 minutes later.

Based on records received and an interview conducted with adult (A2) on 11/13/25, a student at neighboring Ridgeway High School reported to A2 that two babies were in the middle of the street (Ridgeway Avenue). A2 stated during the interview that a school employee, A3, went out to Ridgeway Avenue, observing infant C2 walking back to the day care and infant C1 standing on the sidewalk on the high school side of Ridgeway Avenue, the opposite side of street from the day care. A2 reported that A3 took C1’s hand, walking them safely across the street. A2 and A3 made sure C2 went back through the gate, where other children were observed. A2 reported that A2 and A3 then went to the front door of the home, returning C1 to the adult inside the home.

On 11/13/25 LPA received records from Santa Rosa Code Enforcement Division employee, A4. Based on a review of records, letters dated 11/26/2003 and 06/08/2004 were addressed to L1 and sent to L1's home address, from Santa Rosa Code Enforcement. The letters stated that the walls constructed in the garage, dividing it into two rooms and a hall must be removed by obtaining a demolition permit to remove the walls and return the garage to its original use. A statement from Santa Rosa Code Enforcement employee, A1 dated 11/06/25 states that records confirm that no valid building permit exists, authorizing the utility space to be used for sleeping accommodations. Based on A1’s written statement, 3 children were observed sleeping in the detached garage, with the door open and no heat source during a tour of the facility on 11/05/25.

During today's inspection L1 and assistant S1 were supervising a total of 5 children, observed occupying the main home only. During today’s inspection LPA toured the facility, received a current roster of children in care, and conducted interviews with L1 and assistant, S1. L1 stated during the interview that she knew that the gate in the backyard was loose and had moved the safety gate that had been barricading it, to another area to block a space that was muddy from the rain on 11/05/25. L1 stated that at the time of the incident, that she was changing a diaper in the main home while assistant S1 was outside with the remaining 9 children in care. S1 stated that while L1 was inside, it began to rain and she was assisting children up the two patio steps to get all of the children inside. LPA noted that the gate area cannot be seen while standing at the patio steps.

Both L1 and S1 reported to LPA that they have spoken about how to prevent children eloping in the future, first by making any necessary repairs to fencing/gates right away and by better communication with one another about announcing how many children they have and where they are transitioning to, and counting children, always knowing how many they have and where they are.

LPA requested to tour the detached garage. L1 stated that they are no longer using the detached garage, only using it as storage as directed by Santa Rosa City Code Enforcement on 11/05/25. LPA and L1 stood in the detached garage, which was unoccupied and was not heated at the time of the inspection. LPA's portable thermometer read a temperature of 62.6 degrees inside with the door open. L1 stated that on 11/05/25 when children were using the room for nap, the portable heater was not in use and the door remained open. LPA did an internet search for the outdoor temperature on 11/05/25, which stated that it was 61 degrees at 12:00pm. Based on LPA's review of a weather App, today's temperature is similar, reading 62 degrees at 12:00pm. LPA explained to L1 that although there is no specific temperature requirement for Family Child Care Homes, that it must be a comfortable indoor temperature. Based on an internet search, a comfortable indoor temperature is generally considered to be between 68 and 72 degrees. LPA shared with L1 that licensed Child Care Centers must maintain a temperature of at least 68 degrees. During the tour of the detached garage L1 stated that she did receive notice about 20 years ago that the converted garage needed to have the walls removed, due to not being permitted. L1 stated that she did have the work completed, removing the walls and then at some point made changes again, but did not obtain permits, and was using the space for storage. L1 stated that she was never asked if the space was permitted during the licensing process and has a license and fire clearance to use the space. LPA verified this to be true.

Based interviews conducted and records reviewed, the preponderance of evidence standard has been met; therefore, the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22 are cited on the attached LIC9099-D pages and an immediate $500.00 civil penalty is being assessed for absence of supervision. This report was reviewed and discussed with Licensee, Sabrina Meyer. Appeal Rights were provided.

Notice of Site Visit shall be posted for 30 days from today's visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

The Licensee stated that she had the gate repaired by a handyman on 11/10/25 when the facility was closed. LPA confirmed that the gate was secure and the yard fully fenced during today’s inspection.

Based on interviews conducted and records reviewed, two infants C1 and C2 left the facility backyard unattended and were found on the sidewalk and then retuned by passerby’s on 11/05/25, which poses an immediate health and safety risk to the children in care.

Licensee (L1) has discontinued the use of the detached garage. L1 will submit an updated form LIC999A to LPA Strother by 11/21/2025, labelling the detached garage as "off-limits". L1 will also submit a written statement regarding L1's understanding the detached garage can not be used for care and her written understanding of what a comfortable indoor temperature is, and her intent to maintain this temperature in the main home.

Based on interview and record review the converted garage used by children was not kept at a comfortable temperature on 11/05/25 while used for napping. Additionally, Licensee had knowledge that the converted garage was converted without the permits prior to licensure and had prior experience with code enforcement, with knowledge that changes to the garage required permits, both which pose potential risk to the health and safety and personal rights of children in care.
