32 | L1 called the guardians of 3 infants, requesting for them to pick up their child. At 11:17am infant C2 was picked up. At 11:26am infant C7 was picked up. At 11:51am child (C12) arrived. At 12:10pm infant C4 was picked up and child C13 arrived. At 12:10pm the facility ratio was in compliance with 4 infants (C1 & C4-C6) and 6 preschool age children (C8-C13), supervised by L1 and two assistants, S1 and S2.
Beginning at 11:45am LPA interviewed S1 and S2. Based on interviews with L1, S1 and S2 the facility has operated over ratio, with more than 4 infants in care and up to 14 children in care, none of whom were 6 years old or school-age, on more than one occasion. Interviews did not corroborate that the facility has ever had more than 14 children in care and was not operating over capacity, just over ratio.
Based on interviews, observation and a review of records, the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22), is being cited on the attached LIC9099D. Appeal rights were provided.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee.
LPA Amy Strother informed licensee, Emilio Perez that this report dated 02/28/24 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Amy Strother informed the licensee to provide a copy of this licensing report dated 02/28/24 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. |
