A subsequent complaint investigation visit was conducted today by Licensing Program Analysts (LPAs), Sebastian Phouthavong & Jennifer Patel who met with Facility Representative, Karen Guerin for the purpose of delivering complaint investigation finding for the above allegations. LPA, Sebastian Phouthavong previously conducted an inspection on 05/23/2025 to initiate the investigation and met with Director, Melanie Campbell (D1) to discuss the allegations, conduct interview(s), make observations, and request documents. LPA also conducted inspections on 06/13/2025. It was alleged that Staff do not ensure the facility is free of pests or insects and that alleged that Staff yell at children in care

During the course of the investigation, LPA conducted interviews with Licensee, Vara Durai (LS), Director (D1), two Staff (S1 & S2), four daycare children (C2 – C5) & five adults (A3 – A8) and attempted two interviews with two adults (A2 & A9) from 05/23/2025 to 08/13/2025. D1 and Staff (S1 & S2) admitted there was an incident when ants were observed in one child’s lunchbox. D1 and S1 further stated that the issue was immediately addressed.

Furthermore, D1 and Staff (S1 & S2) stated there was another incident when ants were observed inside the facility’s hallway wall.



In addition, D1 admitted there was a recent staff member that yelled at the daycare children and would make inappropriate comments towards the children. D1 further stated that the issue has been addressed, and the staff member is no longer associated with the facility. An interview conducted by S2 also stated that to have observe the staff member yelling the daycare children, corroborating with D1’s statement. According to interviews conducted with Adults (A4 & A5) stated to have observed a staff member yelling at daycare children when at the facility as well.

Based on the information gathered during this investigation, the preponderance of the evidence standard has been met. Therefore, the allegations are determined to be substantiated. California Code of Regulations, Title 22, is being cited on the attached LIC 9099-D. Appeal rights were provided. An exit interview was conducted, and this report was read and discussed with the Facility Representative, Karen Guerin. The Notice of Site Visit shall be posted for 30 days.

During the course of the investigation, LPA conducted interviews with Licensee, Vara Durai (LS), Director (D1), two Staff (S1 & S2), four daycare children (C2 – C5) & five adults (A3 – A8) and attempted two interviews with two adults (A2 & A9) from 05/23/2025 to 08/13/2025. D1 denied the allegations. D1 and Staff (S1 & S2) stated that daycare children bring their own water bottles from home and are filled up with more water throughout the day.

D1 and Staff (S1 & S2) further stated if a water bottle is forgotten, and water cups are available on site. Additionally, D1 stated there are water jugs on site and S1 stated there is a water pitcher available when indoor and outdoors. D1 and Staff (S1 & S2) also stated that water breaks are conducted, reminding children to drink water.

Additionally, D1 and S1 stated that staff would check diapers every two hours and children would be reminded to use the bathroom throughout the day. D1 and Staff (S1 & S2) also stated if a child has a potty accident, staff would immediately change the child and have extra clothes available at the facility. D1 and S1 did state that there was a recent incident when a child with soiled pants was brought to their attention; unaware of when it occurred and for how long the child been left wearing soiled clothing.

In addition, interviews conducted with Adults (A4 & A5) have stated that there were a few times when their children would be picked up from facility and appeared dehydrated, unsure if enough water was provided for them. Interviews from Adults (A4, A5 & A8) also stated that there were times when their children would have soiled clothing when picked up and unsure of how long they were left in the clothing. Interviews conducted by daycare children (C2 – C5) stated to that they have access to their own water bottle at all times. Adults (A6 - A8) and Daycare Children (C2 – C5) did not have any current concerns with the allegations filed against the facility.

Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with Facility Representative, Karen Guerin Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
