A subsequent complaint investigation visit was conducted today by Licensing Program Analysts LPA(s), S. Phouthavong and M. Mohr who met with Licensee, Zoe teeter and Director, Dana Powell for the purpose of delivering complaint investigation findings for the above allegations. LPA previously conducted an inspection on 11/14/2024 to initiate the investigation and met with Licensee to discuss the allegations, conduct interview(s), make observations, and request documents. It’s alleged a day care child sustained injury while in care, specifically child 1 (C1) received a lesion while at the facility. Also, its alleged that that staff did not notify day care child's parent of injury, specifically that the C1’s parents were not notified of the lesion. Finally, its alleged that staff yelled at day care children, specifically that two staff were screaming at the children on the playground.

During the course of the investigation, LPA conducted interviews with the Licensee (LS), Director, (D1) three Staff (S1 – S3) and three Adults (A1 – A3) from 11/14/2024 to 01/24/2025. LS and D1 denied the allegations.

LS, D1 and S1 stated on the alleged date, S1 observed a small red mark on C1 when conducting a diaper change but unknown of when received and if occurred while at the facility. S1 further stated C1 did not show signs of being in distressed and thought the red mark was the start of a diaper rash. LS stated she was first notified of the injury by C1’s parent and recommended C1 get checked by a doctor. In addition, LS and D1 stated D1 spoke with C1’s parent on the incident and informed them of the reporting procedure. Interviews from staff (S1 – S3) stated the facility procedure for an incident/injury is to immediately check on the child and notify their parents. LS stated recently the facility has updated the facility’s procedure and would now notify daycare parent of any marks, small or big. It could not be determined the severity of the injury and could not be confirmed if it occurred while at the facility.

In addition, LS, D1 and Staff (S1 – S3) stated staff do not yell at child. LS and S1 stated staff do raise their voices to get daycare children’s attention or if it’s for any safety reasons. LS stated staff would make comments including to “Line Up” when outside and S1 stated staff would raise their voice for children to “stop” for safety reasons.

Interviews conducted by Adults (A1 – A3) have stated to have been notified of incident involving their child and currently did not have any concerns with the allegations filed against the facility.

Based on the information gathered during this investigation, although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the Licensee, Zoe Teeter. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
