An unannounced follow-up complaint investigation visit was conducted by Licensing Program Analyst (LPA) Y. Yang to deliver the findings of the complaint investigation. The allegation stated that staff were not providing adequate supervision to day care children. Specifically, it was reported that children in the preschool classrooms were not being adequately supervised, resulting in staff being unable to consistently meet the children's supervision needs.

During the initial complaint investigation visit conducted on May 11, 2026, LPA Yang interviewed Center Director Mario Zettler (Staff S1) regarding the allegation. Director Zettler acknowledged concerns related to staff supervision and stated that he believes there have been instances in which children were not adequately supervised in the preschool classrooms. In a follow up visit on May 26, 2026, the Director cited two incidents that occurred during the course of the investigation as examples of inadequate supervision. On May 14, 2026, children C1 and C2 eloped from the facility.On May 19, 2026, child C1 again eloped from the facility. In both instances, the Director stated that the children were found in the facility's parking lot.Director Zettler stated that these incidents demonstrated deficiencies in classroom supervision. He further reported that multiple teachers had expressed feeling overwhelmed while supervising children in their classrooms, despite the center operating within the required staff-to-child ratios. As part of the investigation, LPA Yang interviewed Staff S2 through S12 on May 11, May 26, and June 18, 2026. The staff members interviewed generally corroborated Director Zettler's statements and acknowledged that the level of supervision provided in some preschool classrooms could be improved. Staff explained that, due to the young ages of the children enrolled and the need to provide routine care, including diaper changes, teachers are sometimes required to divert their attention from the group to attend to an individual child's needs. Staff stated that during these moments, other children may move quickly throughout the classroom, making it difficult to immediately intervene in all situations. Staff further reported that, despite their efforts to monitor children, redirect behaviors, and intervene promptly, some children have bitten or injured other children before staff were able to prevent the incidents. Staff indicated that these circumstances have contributed to challenges in maintaining consistent supervision of all children, even while operating within the required staff-to-child ratios.

Based on the Director's admissions, staff interviews, and information obtained throughout the investigation, the preponderance of evidence standard has been met. Therefore, the allegation is substantiated. A violation of California Code of Regulations, Title 22, is being cited on the attached LIC 9099-D. An exit interview was conducted and his report was reviewed and discussed with with the facility representative, Deinte "Ares" Lewis. Appeal rights were provided, and the Notice of Site Visit was issued any shall be posted in a prominent location for 30 days.

An unannounced follow-up complaint investigation visit was conducted by Licensing Program Analyst (LPA) Y. Yang to deliver the findings of the complaint investigation. The allegation stated that the facility was operating over the required staff-to-child ratio. Specifically, it was alleged that, on more than one occasion, certain preschool classrooms had only one teacher supervising 13 awake children, exceeding the maximum staff-to-child ratio permitted by regulation.

During the initial complaint investigation visit conducted on May 11, 2026, LPA Yang interviewed Center Director Mario Zettler (Staff S1) regarding the allegation. Director Zettler denied that the facility operated over the required staff-to-child ratios and stated that staffing schedules are developed to ensure compliance with California Code of Regulations, Title 22. The Director further stated that classroom attendance is monitored throughout the day and staff assignments are adjusted, as needed, to maintain the required staff-to-child ratios. As part of the investigation, the LPA conducted observations of the preschool classrooms during multiple unannounced visits. Based on these observations, the staff-to-child ratios remained in compliance with licensing requirements, and the LPA did not observe any instances in which the facility exceeded the required staff-to-child ratios. The LPA also interviewed Staff S2 through S12 on May 11, May 26, and June 18, 2026. Staff consistently stated that, although classrooms could become busy and staff occasionally felt overwhelmed due to the supervision needs of young children, including diaper changing and attending to children's individual needs, the classrooms remained within the required staff-to-child ratios. Staff reported that additional assistance was requested from management whenever needed to maintain compliance with licensing requirements. Staff further explained that these requests for support most commonly occurred during the morning arrival period and as children were waking from their scheduled nap, when children's supervision needs temporarily increased. None of the staff interviewed reported observing or participating in situations where a single teacher was assigned to supervise 13 or more awake preschool children.

Although the investigation identified concerns related to staff supervision and the challenges associated with caring for preschool children, there was no preponderance of evidence obtained to support the specific allegation that one teacher supervised 13 awake preschool children on more than one occasion. Observations conducted during the investigation and staff interviews did not reveal any instances in which the number of awake children exceeded the number permitted under the required staff-to-child ratios.

Based on available information and interviews conducted, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegation is determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with with the facility representative, Deinte "Ares" Lewis. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.

Responsibility for Providing Care and Supervision. No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.

The facility representative stated that the facility's supervision policies and applicable Title 22 requirements have been reviewed with all staff. Staff were reminded that they must maintain continuous visual supervision of children at all times and ensure required teacher-child ratios are maintained during classroom activities, transitions, and outdoor play. The facility representative also stated that all staff will complete documented training on active supervision and supervision responsibilities by July 31, 2026. To monitor compliance, the Director will conduct classroom observations for the next 30 days, provide coaching or corrective action as needed.The facility will continue ongoing monitoring to ensure children receive adequate supervision at all times and to prevent recurrence of this deficiency.

Based on the director's admissions, staff interviews, and information obtained during the course of the investigation, it was determined that there were multiple instances in which children were not provided with adequate supervision while in their classroom. Thisposes a potential risk to the health and safety of children in care.
