On 08/26/26 at 9:15am, Licensing Program Analyst (LPA), Amy Strother conducted an unannounced Case Management inspection for an increase in capacity. Upon arrival, LPA met with Applicant/Facility Representative, Richard Burchett. Applicant is requesting to be licensed for 12 Toddler children ages 18-36 months in the Kingfisher classroom and 39 Preschool children ages 2 years to entry into first grade in classrooms, Sandpiper and Heron. Hours of operation will be Monday through Friday, 7:45am – 5:30pm. The capacity request includes 15 additional Preschool children, using an additional indoor and outdoor space, named Sandpiper. Present during today’s inspection were 23 children with 4 staff, between the Heron and Kingfisher classrooms. Appropriate ratios and supervision were observed. All indoor and outdoor activity space utilized for the children was inspected today. LPA informed Richard Burchett that staff are required to maintain direct visual supervision of the children at all times during indoor and outdoor activities.

LPA continued to tour the facility and measured new additional indoor activity space; Sandpiper Classroom. Total indoor activity space measured 774.60 feet, which is sufficient to accommodate the requested capacity of 15 additional Preschool Children. LPA observed all indoor activity space to be complete with safe, age-appropriate furniture and equipment, including tables, chairs, cubbies, napping cots/mats, bookshelves, and other activity supplies for the children. Drinking water is available indoors, provided via water jug filters and water bottles. LPA observed all hazardous items to be inaccessible to children. There are no bodies of water or weapons on the property. Fire clearance was granted on 07/30/26 for 12 additional children. During today’s inspection the applicant updated the capacity increase request to 15 additional children. LPA spoke with Sonoma County Fire District, Fire Marshal who verbally agreed to increase the fire clearance by 3 children.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

LPA observed a total of 2 sinks and 1 toilet available for children’s use. These are sufficient to accommodate the requested capacity of 15 children.

LPA continued to tour the facility and measured new additional outdoor activity space; Sandpiper Yard. The facility currently has a fully fenced playground area. Fencing is wooden is at least four feet high. Total outdoor activity space measured 4526.20, which is sufficient to accommodate the requested capacity of 15 additional Preschool Children. Shade is provided via trees and overhang on deck area. There are sufficient outdoor age-appropriate toys and play equipment available on the playground. There is currently a climbing structure on the yard without an age rating. Applicant stated he will remove the structure. Drinking water is available via water jug filters and water bottles. LPA observed all hazardous items on the playground to be inaccessible to children. Applicant Richard Burchett was reminded that any changes to the facility must be reported to and approved by Community Care Licensing.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test as specified in Health and Safety Code section 1597.16.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP.).

LPA verified that the lead testing was completed in accordance to the Written Directives (Interim Licensing Standards) outlined in PIN 21-21.1-CCP. Based on file review, this facility last tested their water for lead on 11/19/24.

The following corrections are needed prior to the issuance of the capacity increase on the license:


1. Add a door way barricade to the storage room in Sandpiper bathroom area.
2. Add a closet size door way barricade to the storage room in nap room.
3. Remove the climbing structure from the Sandpiper yard.
4. Obtain an updated fire clearance from Sonoma County Fire District, Fire Marshal for an increase of 15 children, maximum capacity of 51.
