Licensing Program Analyst (LPA) Jen Patel conducted an unannounced complaint investigation visit to the facility and met with the licensee, Jaya Lopez (L1), for the purpose of delivering findings related to the above allegation. LPA Jen Patel and Jamie Clark previously met with L1 on 1/22/2026 to open the complaint. From 1/22/26 through 3/23/2026, interviews were conducted with three adults (A1-A3), three children (C1-C3), and three parents (P1-P3). During the course of the investigation, LPA Patel conducted interviews, received documents pertaining to the investigation, and made observations. Additional adult interviews were attempted.
L1 denied the allegation, stating they supervise the children by keeping them in the same area together. L1 further stated that if she is inside and her assistant is in the backyard, the window remains open so she can maintain auditory supervision of the children. L1 also stated daycare children do not play in her front yard, as it is not licensed.
Interviews with A1-A3, P1-P3, corroborated that daycare children do not play in the front yard. A1-A3 stated they have never seen unsupervised children playing in the front yard. A2 stated they sometimes see the licensee’s older children riding bicycles out front after 5pm. A3 stated they saw L1’s own children playing outside with an adult.

P1-P2 stated their experience at daycare has been excellent, and children are not allowed to be in the front yard. P1-P2 further stated the daycare has a child gate that blocks the children from going in the front yard. P3 stated they have had the best experience at this daycare and have never seen children riding bikes in the front yard.

LPA’s record review conducted on 3/24/26 confirmed the front yard is off-limits to children in care. Furthermore, during an inspection on 01/22/2026 LPAs observed the children playing in the backyard supervised by the Licensee and her assistant, as well as the front yard gate to be closed.

During the investigation, the LPA did not observe circumstances in which staff are providing inadequate supervision to children in daycare, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred and therefore is determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with licensee, Jaya Lopez. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
