On 11/17/2023, Licensing Program Managers (LPMs) Cynthia Brannon, Juvenal Moctezuma, and Licensing Program Analyst (LPA) Anita Tristan met with Licensee, Alis Odesho for an informal meeting at the Fresno Regional Child Care Office. Present today is also Child Care Specialist with the Office of Education, Lydia Ibarra. The purpose of today's informal meeting was to discuss a case management inspection that was conducted on 11/03/2023 regarding an incident that occurred on 10/24/2023 in which licensee provided care in an unlicensed home. During that inspection, licensee had an in-ground pool that did not meet Title 22 regulations. LPMs Brannon and Moctezuma reviewed and discussed the deficiencies with Alis Odesho and how the Family Child Care Home will maintain in compliance with the deficiencies cited below.

The Department of Social Services, Community Care Licensing Division has determined that Alis Odesho Family Day Care Home violated the following Title 22 licensing regulations/California Health and Safety Codes:

On 11/3/2023, LPA Tristan issued two Type A deficiencies for violations of California Code of Regulations Title 22 Division 12 and one Type A deficiency for the violation of Health and Safety Code.

· Type A deficiency for violation of California Code of Regulations Title 22 Division 12 Section, License 102368(b) - The license shall not be transferred to other individuals or locations. This requirement was not met as evidenced by licensee stating that she provided care to day care children in the home of her assistant. Assistant’s home is an unlicensed home.

· Type A deficiency for violation of California Code of Regulations Title 22 Division 12 Section, Operation of a Family Child Care Home 102417(g)(5) - The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fishponds, and similar bodies of water through a pool cover or by surrounding the pool with a fence. This requirement was not met as evidenced by licensee not having a pool cover or surrounding her inground pool by a fence that meets title 22 Regulations. A $500.00 immediate civil penalty was also issued.

· Type A deficiency for violation of Health and Safety Code Section 1596.885(c) - Conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of this state. This requirement was not met as evidenced by Licensee not calling the Fresno Regional Office and reporting that she was making structural changes to her home and was going to provide daycare services at an unlicensed location which through interviews conducted, it was revealed that there were unfingerprinted adults in the unlicensed home while children were being cared for. Licensee’s conduct poses a health & safety risk to children in care.

The above deficiencies were reviewed and discussed during today's informal meeting. Facility has implemented a plan of correction since the day of the incident. These deficiencies were cleared on 11/16/2023.

COMPLIANCE PLAN

In response to these discussions, Licensee has agreed to the following:

1. Licensee will ensure children are provided with a safe and healthful environment and the home shall be free from defects or conditions which might endanger a child.

2. Licensee shall attend the Family Child Care Orientation and submit the certificate of completion to the Department by no later than 12/01/23. This is to ensure that licensee is aware of community care licensing title 22 regulations and to help her get a better understanding of care and supervision of children, reporting requirements, pool regulations, and operation of a family child care home to stay in compliance.

3. Licensee agrees to comply with Title 22, Division 12, Chapter 3 of the California Code of regulations.

Licensee shall submit a written plan to Community Care Licensing Division and certificate of training attended by 12/01/23 indicating how she will comply with the above requirements. In addition, it was recommended that the licensee connects with her local resource and referral agency for additional support and training.



Today, Licensee was informed that any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action. Furthermore, Licensee understands that any repeats of the above deficiencies within a 12-month period will result in the issuance of civil penalties.

A copy of this report was given to Licensee, Alis Odesho. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, No Deficiencies are cited during today’s Office Visit.
