On January 31, 2023, Licensing Program Analysts (LPAs) Bapstista and Brannon conducted a case management inspection. LPAs met with Center Supervisor, Michelle Higginson. Licensee of facility is Stanislaus County of Education.

Fresno Regional Child Care office received an Unusual Incident Report for an incident that occurred on January 18, 2023 between two children that resulted in inappropriate interaction between two children. During today's inspection, LPAs took a census, toured facility, interviewed staff, reviewed staff and children's files.

During today's inspection, LPA observed two classrooms. Staff are storing children's mats in the children's restroom. Per Title 22, section Buildings and Grounds 101238 (d)(1) General permanent or portable storage space shall be available for the storage of the center's equipment and supplies. Such equipment and supplies shall be stored in this space and shall not be stored in space used to meet other requirements specified in Title 22. Per Center Supervisor, at one time, licensee was providing two half day sessions in one classroom and one full day session in the other classroom. Currently licensee is providing full day sessions to both classrooms. Center director was not aware that children's restroom cannot be used as storage.

LPA observed that staff are utilizing corner mirrors to provide supervision to children while in the restroom. LPA informed center supervisor that mirrors do not replace visual supervision required by staff. LPA informed center director that staff are to utilize direct visual supervision of children in care.

On January 18, 2023, child #1 ran into another child's stall and inappropriately touched child #2. Staff #1 was in the restroom, by herself, providing supervision to three children. Staff #1 was standing in the restroom and was unable to move quickly to prevent child #1 from interacting with child #2 while leaving the restroom. After the incident, staff #1 informed center supervisor, Michelle Higginson of the incident that took place. Parents of children #1 and #2 were called and informed of the incident.

Licensee, Stanislaus County of Education, has been addressing child #1's behavior before the January 18, 2023 incident. Resources, conferences and additional staff support in classroom has been provided. Observations of child #1's behavior and social interaction has been conducted by licensee and provided behavior support program specialist (BSP) from the disability team of Stanislaus County Office of Education. Licensee has decreased child #1s daily full time attendance to half day attendance.

Based upon today's observations, interviews, documentation of conferences, licensee utilizing extra staff to assist in classroom and decreasing child #1's daily hours of attendance; this facility has adequately met compliance requirements.

Per California Code of Regulations Title 22, Division 12, no deficiency to be cited during today's inspection. Exit interview conducted with Michelle Higginson. Appeal Rights were given and discussed during today’s inspection. A copy of this report needs to be placed in facility file for public review. A Notice of Site Visit was posted on parent board for 30 days.
