32 | LPA found no record in children’s file with a signed incident report by a parent/legal guardian for at least two incidents referenced in an accident report dated 08/26/2022 and staff witness statement dated 11/02/2022 confirming that communication was provided to the respective children's parents to support that staff had a plan in place to prevent a day care child from inappropriately touching another child.
Based upon information derived from interviewing the reporting party (RP), witnesses, parents, staff, and records reviewed including facility records the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated.
Regarding the allegation that "Facility was out of ratio" observations, interview statements, and records reviewed that included facility records yielded that on at least on three dates to include 04/15/2024, 04/29/2024, and 05/13/2024 the facility exceeded ratios of one teacher visually observing and supervising 12 children; records obtained for the respective dates above displayed counts of 1:16, 1:13, and 1:17 teacher-child ratio. LPA staff interviews yielded statements outlining patterns that the facility was out of ratio on several occasions to at least capture the mentioned dates above.
Based upon information derived from interviewing the reporting party (RP), witnesses, parents, staff, and records reviewed including facility records the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated.
Regarding the allegation that "Staff did not notify day care children's parents of incidents" observations, interview statements, and records reviewed to include facility records yielded that the facility did not comply with ensuring that staff communicated information to parents/legal guardians regarding unusual incidents as evidenced by a missing incident report in a child's file, C4, documenting that on 05/14/2024 at approximately 10:00 am C4 was left unsupervised for approximately one to two minutes within the facility during a transitional period to a next routine activity. LPA found no record in the corresponding child's file acknowledging the event occurred and there were no documented efforts for transparency and accountability in the child's file. Interviews and records reviews corroborated that that the incident occurred and there was no incident report on file acknowledging staff notified the child's parents of the incident via having a signed copy of an incident report within C4's file.
