On September 27, 2022, Licensing Program Analysts (LPAs) Joseph Pacheco and Cynthia Brannon conducted an announced prelicensing inspection and met with Director, Elisha Hawkins. LPAs explained the reason of the inspection and a tour of the center was conducted both inside and outside. This is a new facility and the applicant is requesting 57 preschool, ages 2-6 years old. Based on today’s inspection LPA observed that facility has 5 toilets and 3 sinks which will not meet the requirements for the requested capacity. Licensee is now requesting a capacity of 45 preschool children based on the amount of toilets and sinks observed. This program will operate year round Monday – Friday, 6:30am – 6:00pm. This program will operate in three classrooms, Classroom 2, Classroom 3 and Classroom 4. Licensee is Sunny Grove Education Corporation. LPAs observed alarms on the doors in Classrooms 2, 3 and 4 which lead to the outside of the facility. Parents will bring their children into the classroom and sign them in, staff conduct daily health checks and conduct a risk assessment. Director stated that it is optional for staff and children to use masks while indoors. LPA reminded Director that the Public Health Department and CDC strongly recommends for staff and children to wear face masks.

Director stated that the center will provide breakfast, lunch, AM snack and PM snack. The meals are prepared onsite. Ill children will be isolated in the Director’s office and utilize the adult bathroom in Classroom 3.

The classrooms were observed to be clean and free of toxins. LPA observed that the furniture and equipment appeared to be safe and in good condition. There are enough tables, chairs, cots, and plenty of toys for children to play. LPA also reminded Director not to store anything on top of high bookcases/storage cabinets that could potentially fall on children. There is a working carbon monoxide detector inside the classrooms.



LPA reviewed with Director, that any future changes to the classrooms are required to ensure that furniture does not tip over on to children, the furniture are to be anchored or situated that tipping does not occur. Classroom changes of furniture shall be situated that 100% visual supervision is always provided to children in care.

Per Director, bathroom procedures when taking children to the restroom shall require staff to stand at the door to assist a child if needed. Per Director, staff will escort children in Classrooms 2 and 4 to the restroom located in the hallway. Director is aware the ratio is 1 Teacher to 12 children and will follow the regulations.

Room measurements were taken and reviewed with Director. The total inside preschool area measured to an approximate 2020 square feet which will accommodate the requested capacity of 45 preschool children. There is adequate storage space available for children's belongings in the classroom. Director understands that children's equipment needs to match the licensed capacity. Toys and equipment appear to be age appropriate.

Licensee is providing the following to provide accessible drinking water to children in care: LPAs did not observe water indoors from a non-contaminated fixture. For the outside drinking water, licensee is providing an igloo with disposable cup dispenser with disposable cups.

The approximate outside square footage for the preschool area is 3556 which will accommodate requested capacity of 45 Preschool Children. During inspection of the outdoor play area, LPA’s observed two tiles missing on the roof. Director stated that the landlord has been notified.

LPA observed age appropriate toys and play equipment. There is shade available where children can rest and get water. Licensee has a shade structure. Mature trees provide additional shade. LPA reminded Director to provide adequate supervision at all times. The outdoor play area contains a planter that will be used as a planting area for children. Director understands that the wood chips in the planter are for landscaping and can not be used for cushioning.

A fire clearance of 57 preschool children was approved and granted by the City of Modesto Fire Department on September 22, 2022.

This facility plans to provide Incidental Medical Services – IMS. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. A Plan of Operation that includes IMS must be submitted to the Department. Director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.

LPA also informed Director, of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The following items must be completed prior to issuing a license by 10/6/22 or sooner

Inside Daycare:


1) Purchase indoor water dispenser and disposable cups with dispenser in Classrooms 2, 3 and 4.
2) Replace broken roof tiles in Classroom 4
3) Install cubby divider for coat storage in Classroom 3
4) Remove items from the counter in Classroom 3
5) Put a lock on the kitchen door to make inaccessible to children.
6) A new fire inspection will be needed for 45 preschool children.
7) Adhesive Tape and First Aid Scissors to be purchased for first aid kit.

Outside Daycare:
1) Replace the one or two missing tiles on the roof.
2) Remove cobwebs along the fencing.
3) License number to be included on the advertising banner.
