On 12/19/24 at 9:30 am, Licensing Program Analysts (LPAs), Joseph Pacheco and Ka Vang conducted an announced Pre-Licensing inspection for a conversion to a single license facility due to facility wanting to add a school age component. Upon arrival, LPA met with Director, Cassi Torrez. Facility is currently licensed for 75 preschool children (500300724) and 24 infant children (500312341). Applicant is requesting to be licensed for 75 preschoolers ages 2-6 in classrooms 302 – 304 in Cooper Hall; 24 infants ages 0-2 in classroom 205 in the Children’s Center; and 40 school age children ages 5-12 in classrooms 401 – 404 in Covell Hall. Hours of operation for all components will be Monday – Friday 7:30 am – 5:30 pm. This facility will operate year-round.
All indoor and outdoor activity space utilized for the children was inspected today. LPA informed Director that staff are required to maintain direct visual supervision of the children at all times during indoor and outdoor activities. When medications are on site, Director stated that they will be in a lock box on top of the refrigerator in the child’s classroom. A fully equipped first aid kit is located in each classroom. There is an operational carbon monoxide detector on site located in each classroom. All required licensing documents were observed posted in the in the lobby for each component. Children will be signed in and out electronically on the Brightwell app. Facility has a back up plan in place to have children signed in and out manually in the event the app is not working.
LPA continued to tour the facility and measured all indoor and outdoor activity space. Total indoor activity space for the infants measured to an approximate 843 square feet which is sufficient to accommodate the requested overall capacity of 24 infant children. Total indoor activity space for the preschool children measured to an approximate 1,667 square feet which is only sufficient to accommodate up to a maximum of 47 preschool children based on requirements of 35 square feet per child for indoor activity space. Total indoor activity space for the school age children measured to an approximate 1,890 square feet which is sufficient to accommodate the requested overall capacity of 40 school age children. LPA observed all indoor activity space to be complete with safe, age-appropriate furniture and equipment, including tables, chairs, cubbies, napping cots/mats, bookshelves, and other activity supplies for the children.

Infant toys are safe with no sharp edges, splinters, or points, nor made of small parts that can present a choking hazard. Drinking water is available in the classrooms via filtered water pitchers. LPA observed all hazardous items to be inaccessible to children. There are no bodies of water or weapons on the property. Fire clearance was granted for 24 infants ages 0-2, 75 preschool children ages 2-6 and 40 infants ages 5-12 by the Modesto Fire Department on 11/20/24.
In the infant room(s) high chairs and feeding tables have broad-based legs, plastic seats are in good repair and trays lock onto chairs. High chairs are made of washable, moisture-resistant material. Changing tables have at least 1” padding covered with moisture-resistant, washable material. Sides of the changing table are at least 3” high. One of the diaper changing tables was observed to not be within arms reach of a sink while in use. Diapering sink is not used for meal preparation or dishwashing. LPA’s observed the facility to be using mostly play yards for infant sleeping and not cribs.
Some cribs were observed. Crib area was not separated from the rest of the infant indoor activity space. LPA’s advised Director that the barrier to be installed must be at least four feet high, made of sound absorbing material and allows for supervision of napping children. Sleep logs are kept electronically via an app. LPA’s advised to have a back up plan in place in the event the app is not working. Infant Needs and Services Plans and are kept in the classroom and in the child’s file.
LPA discussed the safe sleep regulations with the Director and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
LPA observed a total of 4 sinks and 3 toilets available for preschool children’s use which is sufficient to only accommodate up to 45 preschool children based on Title 22 requirements of 1 toilet and 1 hand washing sink per every 15 children or fraction thereof. LPA observed a total of 4 sinks and 5 toilets in one bathroom available for school age children’s use which is sufficient to accommodate the requested capacity of 40 school age children. School age restrooms afford privacy for the children. Licensee understands that the school age bathroom can’t be used by boys and girls simultaneously. LPA observed a total of 3 sinks available for infant children’s use. These are sufficient to accommodate the requested overall capacity of 24 infant children. No toilets designated for infants were observed. Potty training services are not provided to infants. Potty training is provided to preschool age children.

There is a separate staff restroom located next to the infant classroom equipped with 2 toilets and 2 sinks. The isolation area for children who are ill will be the Director’s office and they will use the staff bathroom.
Facility will provide morning and afternoon snacks. Parents will provide lunches. Facility has a supply of food on hand in case parents forget to send their child to the facility without a lunch. LPAs observed a kitchenette area inside preschool rooms 302 and 303. The kitchen area was made inaccessible to children via a gate. Food was observed to be properly stored separate from cleaning materials. Hazardous items in kitchen are inaccessible to children via being kept in high storage areas out of reach or behind locked child safety gates.
The facility currently has a separate fully fenced playground area for the infant component and is proposing to have school age and preschool children share the outdoor space adjacent to Cooper Hall at separate times. An approved waiver will be needed to allow for the preschool and school age children to share the same outdoor area. Chain link fencing in the preschool and school age outdoor space is at least four feet high. Wrought iron fencing is at least four feet high in the infant outdoor area. The total square footage for the shared outdoor activity space for the preschool and school age children is 6,994 square feet which is sufficient to accommodate the requested capacity of the preschool and school age components. The total square footage for all the outdoor activity space for the infants is an approximate 2,558 square feet which is sufficient to accommodate the requested capacity of 24 infants. Shade is provided via mature tree in the infant outdoor play area. A second mature tree was observed in the infant outdoor area but there were no leaves on it due to the time of year. No shade structure was observed in the preschool & school age outdoor area. Mature trees are planted but they were completely cut back and unable to provide any shade. There are sufficient outdoor age-appropriate toys and play equipment available on the playground(s). There is a climbing structure in the area to be shared by preschool and school age children which is properly anchored. There is adequate cushioning in fall zones of climber provided by rubber chip cushioning. No sticker indicating the ages of intended use was observed on the play structure in the preschool & school age outdoor area. There is a climbing structure in the infant outdoor area. LPA’s observed a sticker stating the structure is for ages 2-5. LPA’s advised Director to obtain documentation stating that the infant play structure is age appropriate for ages 0-2. There is adequate cushioning via rubber cushioning. LPA’s advised Director to have children not use the structure in the infant outdoor area until it’s confirmed to be age appropriate. Drinking water is available via a water fountain in the preschool and school age outdoor area. In the infant area children bring sippy cups from home and staff bring out a cart with a filtered water pitcher and the children’s sippy cups during outdoor activities. Facility has bottled water on hand in case the infant was dropped off without their sippy cup. LPA’s observed all hazardous items on the playground(s) to be inaccessible to children. Director was reminded that any changes to the facility must be reported to and approved by Community Care Licensing.

Facility had water fountains used for drinking and/or food preparation tested for lead on 11/15/22.

Director, Cassi Torrez was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

LPA reviewed with Director the LIC 311A, Records to Be Maintained at The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Director was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

The following corrections are needed prior to the issuance of the license:

Indoor Area

School age classroom
· Make cabinet with sound equipment inaccessible.
· Make the supply storage room inaccessible.

Infant classroom
· Reposition changing tables so they’re within arms reach of a sink while in use.
· Install a partition that is at least four feet high to separate the crib infant sleeping area from the rest of the classroom.
· Replace play yards with cribs.

Outdoor area

Preschool & School age area
· Fix drainage issue causing water to pool on top of the sandbox cover and in the concrete area near the sandbox.
· Install a shade structure to provide the children with a shaded rest area.

Director understands that all proof of corrections must be provided to the Department within 30 days, or the application may be denied. Upon completion of the above items and approval of the waiver request for the preschool and school age children to share an outdoor activity space at separate times, a recommendation will be made to issue a single license for 24 infant children ages 0-2, 45 preschool children ages 2-6 and 40 school age children ages 5-12.

A notice of site visit was given to Director and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
