On 5/4/23, an Informal Conference meeting was conducted today at the Fresno Regional Child Care Office. In attendance during this meeting was: Licensing Program Manager (LPM), Juvenal Moctezuma, Licensing Program Analyst (LPA), Joseph Pacheco, Licensee, Celia Fuentes-Sanchez and Licensee's family. The purpose of the informal conference was to discuss previous citations, advisory notes and supervision of children in care in regards to an unusual incident that occurred on April 11, 2023. LPM Moctezuma reviewed and discussed the inspection with Celia Fuentes-Sanchez and how the Family Child Care Home will maintain compliance with the deficiencies cited below.

The Department of Social Services, Community Care Licensing Division has determined that Celia Fuentes-Sanchez’ Family Day Care Home violated the following Title 22 licensing regulations:

4/14/23 – Type A – 102417(a) Operation of a Family Child Care Home - The licensee shall be present in the home and shall ensure that children in care are supervised at all times. This requirement was not met as evidenced by Licensee reporting that on 4/11/23, Child #1 went out the side yard gate of the facility and down two street blocks from the facility. Child #1 was alone and unsupervised. This poses an immediate risk to the health, safety, or personal rights of children in care.

7/18/22 – Technical Violation – 1597.622(a)(1) Employees or volunteers at family day care home; immunization requirements; records; exemptions – (a)(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. Licensee did not maintain documentation of immunizations for measles and pertussis for her husband/assistant.

7/18/22 – Technical Violation – 102425(j)(2) Infant Safe Sleep - The provider shall supervise infants while they are sleeping and adhere to the following requirements: The provider shall check and document the following:
Labored breathing, Signs of distress which includes but is not limited to flushed skin color, increase in body temperature and restlessness. Infants up to 12 month of age who are sleeping in a position other than on their back. Licensee stated that the 15-minute nap logs are not completed, but an assistant remains with the napping infant in the room at all times. LPA advised that the nap log must also be completed.

7/18/22 – Technical Violation – 102417(g)(10) Operation of a Family Child Care Home – (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (10) A baby walker shall not be allowed on the premises of a family child care home in accordance with Health and Safety Code Sections 1596.846(b) and (c). LPA observed a baby rocker at the facility and Licensee stated that it is used for infant Child 1. LPA informed Licensee that rockers are not allowed in family child care homes. LPA discussed infant items allowed in family child care homes.

9/23/19 – Technical Assistance – 102416.3(a) Alterations to Existing Buildings or Grounds Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed. During today's inspection Licensee stated the children have not been using the outdoor play area because Licensee is sorting through garage and has hazardous items accessible in the outdoor play area. Licensee is advised to notify Community Care Licensing (CCL) in the future if any changes are going to be made to the daycare. The outdoor play area is made inaccessible as of today and Licensee is to notify CCL when backyard is ready for daycare use. CCL shall inspect the backyard for safety prior to children being allowed access.

4/11/17 - Type B – 102421 Child’s Records - LPA observed two of the children's records were missing the correct information for their immunization's records.

4/11/17 – Type B - 1596.866(b) - Additional health and safety training; condition of licensure - Licensee shall maintain a current CPR and First Aid certification. During today's visit, LPA observed licensee Celia Fuentes-Sanchez has expired CPR and First Aid certification cards.

Licensee has submitted proof of corrections for the above-mentioned citations, and the deficiencies were cleared.

COMPLIANCE PLAN
In response to these discussions, Licensee has agreed to the following:
1. Licensee will ensure children are provided with a safe and healthful environment.
2. Licensee shall attend the Family Child Care Orientation at the Fresno Regional Office on 5/17/23 and submit the certificate of completion to the Department by 5/17/23. This is to ensure that licensee is aware of community care licensing title 22 regulations and to help her get a better understanding of care and supervision of children, record keeping for staff, infant safe sleep and operation of a family child care home to stay in compliance.
3. Community Care Licensing will increase frequency of site visits to the facility to monitor compliance.
4. Licensee agrees to comply with Title 22, Division 12, Chapter 3 of the California Code of regulations.

Licensee shall submit a written plan to Community Care Licensing Division and certificate of training attended by 5/17/23 indicating how she will comply with the above requirements. In addition, it was recommended that licensee connect with her local resource and referral agency for additional support and training. Licensee stated she already has contact information for her local resource and referral agency.

Today, Licensee was informed that any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action. Furthermore, Licensee understands that any repeats of the above deficiencies within a 12-month period will result in the issuance of civil penalties.

A copy of this report was given to Licensee, Celia Fuentes-Sanchez. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, No Deficiencies are cited during today’s Office Visit.
