25 | On 4/14/23 Licensing Program Analyst (LPA) Joseph Pacheco arrived at the facility to conduct an unannounced Case Management inspection. LPA met with Licensee, Celia Fuentes-Sanchez, toured the facility and a census was taken. The purpose of today's inspection was regarding an unusual incident that was reported to the Fresno Childcare Regional Office on 4/11/23. On 4/11/23 Licensee self-reported Child #1 exited the premises through an unlocked side yard gate and wandered away from the facility at approximately 10:15am and was missing for approximately 12-15 minutes before being found by local law enforcement unharmed approximately two blocks away and returned to the facility. Licensee stated that at the time of the incident there were three staff caring for nine children. During an interview with the Licensee during today’s inspection, it was determined that the side yard gate was not closed properly after two daycare children were escorted from the side yard to inside the home.
Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D). Licensee was provided a copy of appeal rights.
LPA Joseph Pacheco informed licensee Celia Fuentes-Sanchez that this report dated 4/14/23 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Joseph Pacheco informed the licensee to provide a copy of this licensing report dated 4/14/23 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with Licensee, Celia Fuentes-Sanchez. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
